Grantee shall insure <br />that the evaluation and treatment of contractors, employees and applicants for <br />employment are free from such discrimination and harassment. <br />Additionally, Grantee, contractors, and subcontractors, if applicable, shall <br />comply with the provisions of the Fair Employment and Housing Act (Gov. Code <br />§12900 et seq.), the regulations promulgated thereunder (Cal. Code Regs., tit. 2, <br />§11000 et seq.), the provisions of Article 9.5, Chapter 1, Part 1, Division 3, Title 2 of <br />the Government Code (Gov. Code §§ 11135-11139.5), and the regulations or <br />standards adopted by the California State Library to implement such article. <br />Grantee shall permit access by representatives of the Department of Fair <br />Employment and Housing and the California State Library upon reasonable <br />notice at any time during the normal business hours, but in no case less than 24 <br />hours’ notice, to such of its books, records, accounts, and all other sources of <br />information and its facilities as said Department or the California State Library <br />shall require ascertaining compliance with this clause. Grantee, and its <br />contractors, and subcontractors shall give written notice of their obligations <br />under this clause to labor organizations with which they have a collective <br />bargaining or other agreement. (See Cal. Code Regs., tit. 2, §11105.) Grantee <br />shall include the non-discrimination and compliance provisions of this clause in <br />all contracts and subcontracts to perform work under the Agreement. <br />37. Notices: All notices and other communications in connection with this <br />Agreement shall be in writing, and shall be considered delivered as follows: <br />a. Electronic Mail (E-mail): When sent by e-mail to the last e-mail address <br />of the recipient known to the party giving notice. Notice is effective <br />upon transmission. <br />b. DocuSign (e-signature platform): When sent via DocuSign a notification <br />will be sent to the last e-mail address of the recipient known to the party <br />giving notice. Notice is effective upon transmission. <br />c. Grants Management System: When sent via / uploaded to the California <br />State Library’s Grants Management System a notification will be sent to <br />the last e-mail address of the recipient known to the party giving notice. <br />Notice is effective upon transmission. <br />d. Personally: When delivered personally to the recipient’s physical address <br />as stated in this Agreement. <br />e. U.S. Mail: Five days after being deposited in the U.S. Mail, postage <br />prepaid, and addressed to recipient’s address as stated in this <br />Agreement. <br />38. Order of Precedence: The performance of this Agreement shall be conducted <br />in accordance with the Terms and Conditions, Procedures and Requirements, <br />DocuSign Envelope ID: E3D1E6B5-ECD8-45D7-B4CD-230528B8419F
