Environmental Checklist <br />Air Quality <br /> <br />Draft Initial Study – Mitigated Negative Declaration 31 <br />BAAQMD Rules and Regulations <br />REGULATION 2, RULE 1 (PERMITS–GENERAL REQUIREMENTS) <br />The BAAQMD regulates new sources of air pollution and the modification and operation of existing <br />sources through the issuances of authorities to construct and permits to operate. Regulation 2, Rule <br />1 provides an orderly procedure which the project would be required to comply with to receive <br />authorities to construct or permits to operate from the BAAQMD, for new sources of air pollutants, <br />as applicable. <br />REGULATION 2, RULE 5 (NEW SOURCE REVIEW PERMITTING) <br />The BAAQMD regulates backup emergency generators, fire pumps, and other sources of TACs <br />through its New Source Review (Regulation 2, Rule 5) permitting process. Although emergency <br />generators are intended to be used only during periods of power outages, monthly testing of each <br />generator is required. BAAQMD limits testing to no more than 50 hours per year. Each emergency <br />generator installed is assumed to meet a minimum of Tier 2 emission standards (before control <br />measures). As part of the permitting process, the BAAQMD limits the excess cancer risk from any <br />facility to no more than 10 per 1-million-population for any permits that are applied for within a 2‐ <br />year period, and would require any source that would result in an excess cancer risk greater than 1 <br />per 1 million to install Best Available Control Technology for Toxics. <br />REGULATION 6, RULE 1 (PARTICULATE MATTER–GENERAL REQUIREMENTS) <br />The BAAQMD regulates PM emissions through Regulation 6 by means of establishing limitations on <br />emission rates, emissions concentrations, and emission visibility and opacity. Regulation 6, Rule 1 <br />provides existing standards for PM emissions that could result during project construction or <br />operation that the project would be required to comply with, as applicable, such as the prohibition <br />of emissions from any source for a period or aggregate periods of more than 3 minutes in any hour <br />which are equal to or greater than 20 percent opacity. <br />REGULATION 6, RULE 6, (PARTICULATE MATTER–PROHIBITION OF TRACKOUT) <br />One rule by which the BAAQMD regulates PM includes Regulation 6, Rule 6, which prohibits PM <br />trackout during project construction and operation. Regulation 6, Rule 6 requires the prevention or <br />timely cleanup of trackout of solid materials onto paved public roads outside the boundaries of <br />large bulk material sites, large construction sites, and large disturbed surface sides such as landfills. <br />REGULATION 8, RULE 3 (ARCHITECTURAL COATINGS) <br />This rule governs the manufacture, distribution, and sale of architectural coatings and limits the <br />reactive organic gases content in paints and paint solvents. Although this rule does not directly apply <br />to the project, it does dictate the ROG content of paint available for use during the construction. <br />BAAQMD Best Management Practices for Construction-Related Fugitive Dust <br />Emissions <br />The applicant shall require all construction contractors to implement the basic cons truction <br />mitigation measures recommended by BAAQMD to reduce fugitive dust emissions. Emission <br />reduction measures will include, at a minimum, the following measures:
