<br />Non-Professional Services Agreement between December 1, 2022 <br />City of San Leandro and Year Up, Inc. Exhibit A Page 1 of 1 <br />EXHIBIT A <br /> <br />SCOPE OF SERVICES <br /> <br />As part of the training experience offered to student participants in Contractor’s internship program (“Year <br />Up Internship Program” or the “Program”), Contractor will place up to 18 workforce development interns to <br />various City of San Leandro departments for the purpose of providing on-the-job training to the students as <br />part of their educational experience (“Services”). The purpose and intent of the Year Up Internship <br />Program is to provide on-the-job training to students who are concurrently enrolled in the Year Up Program, <br />a non-profit experiential training program. Each Intern is either enrolled in a formal program at an <br />accredited college during the Internship experience or is eligible to receive college credit recommendations <br />upon successful Year Up course completion. Contractor and City agree and understand that: the training <br />offered the Interns is similar to that which would be given in an educational environment, including hands - <br />on training; the training is fundamentally for the benefit of the Interns; the Interns will not displace regular <br />employees, and will work under the close observation of regular employees; the Interns are not entitled to a <br />job with City at the conclusion of the training period; the Interns and City understand that the Interns are not <br />entitled to wages for the time spent in training. Moreover, as part of the Interns’ training program, they <br />attend a weekly educational seminar about their training at the Year Up site. No intern shall be expected or <br />required to participate in training in excess of 36 total hours in any work week. <br /> <br />Interns will be assigned to project-based and time-bound assignments. City departments have the <br />exclusive right to screen the intern applicants by way of the City’s standard background check and oral <br />interview process. Interns will be placed in the following departments: City Manager’s Office, Finance, <br />Information Technology, Human Services, Library, Police, Public Works, Recreation. Interns will be placed <br />for a 6-month period. City has discretion to dismiss or remove any intern from an assignment or <br />Department at any time for any reason, or no reason. Because each Intern is participating in an <br />educational training program, s/he is not considered an employee of Year Up or City. Each Intern receives <br />a weekly educational stipend, paid directly by Year Up. The Intern shall not be expected to, or entitled to, <br />participate in direct compensation, health or disability insurance, retirement benefits, or other company <br />welfare or pension benefits (if any) to which employees of City may be entitled. <br /> <br />Year Up provides its program participants with the opportunity to develop essential career readiness and <br />business skills, build foundational technical capabilities, and complete an immersive, work -based <br />experience with a leading employer partner.
