RESPONSE
Emergency Proclamations and Declarations
The California Emergency Services Act 27 and the Robert T. Stafford Disaster Relief and Emergency Assistance Act
Public Law 93-288, as amended (Stafford Act),28 establish a general scheme for managing emergencies.
A proclamaon of local emergency is a crical first step in response to an incident as it expands the emergency
powers and authories of government and acvates the appropriate aspects of applicable mutual aid plans. A
proclamaon of local emergency may also be required to qualify for some post-disaster financial assistance.
A proclamaon of local emergency provides the City of San Leandro with the following:29
• Authority to promulgate emergency orders and regulaons related to protecng life and property.
• Permission to acvate certain pre-established local emergency provisions, such as special purchasing and
contracng.

26 htps://www.sanleandro.org/990/Resilience-Hubs
27
htps://leginfo.legislature.ca.gov/faces/codes_displayexpandedbranch.xhtml?tocCode=GOV&division=1.&tle=2.&part=&ch
apter=7.&arcle=
28 htps://www.fema.gov/disaster/stafford-act
29 htps://library.qcode.us/lib/san_leandro_ca/pub/municipal_code/item/tle_3-chapter_3_4?view=all#tle_3-
chapter_3_4-arcle_1-3_4_110
