IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2024- RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH PACIFIC WEST COMMUNITIES AND THE BAY AREA RAPID TRANSIT DISTRICT, SUBMIT AN APPLICATION TO THE CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR AFFORDABLE HOUSING AND SUSTAINABLE COMMUNITIES PROGRAM FUNDS, AND EXECUTE DOCUMENTS TO ACCEPT THE PROGRAM FUNDS WHEREAS, the State of California is accepting applications for funding under the Affordable Housing and Sustainable Communities (AHSC) Program established under Division 44, Part 1 of the Public Resources Code commencing with Section 75200; and WHEREAS, the City of San Leandro, Bay Area Rapid Transit District, and Pacific West Communities each have projects that when combined qualify for funding under the Program; and WHEREAS, only two entities can be listed on the funding application. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That the City Manager shall submit on behalf of the City an AHSC Program Application as co- applicant with Pacific West Communities in a total amount not to exceed $50,000,000 of which up to $35,000,000 is requested as a loan for an Affordable Housing Development, and up to $15,000,000 is requested for a grant for Housing-Related Infrastructure, Sustainable Transportation Infrastructure, Transit-Related Amenities, or Program activities as defined in the AHSC Program Guidelines; and That the City Manager may enter into an agreement with BART obligating BART to construct certain improvements and obligating the City to forward certain proceeds from the Program Funds to BART, in the event the Program Funds are awarded to the City; and That if the application is approved, the City Manager may execute a State of California Standard Agreement in a total amount not to exceed $15,000,000, and any and all other documents required or deemed necessary or appropriate to secure the AHSC Program funds from the Department and all amendments thereto including an AHSC Program Application and AHSC Documents as required by the Department for participation in the AHSC Program, and That the City Manager is authorized to make non-substantial revisions to said agreement with BART, subject to approval as to form by the City Attorney.
