IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2024- <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AND AUTHORIZE THE CITY <br />MANAGER TO EXECUTE AN AGREEMENT WITH PACIFIC WEST COMMUNITIES AND THE BAY AREA <br />RAPID TRANSIT DISTRICT, SUBMIT AN APPLICATION TO THE CALIFORNIA DEPARTMENT OF HOUSING <br />AND COMMUNITY DEVELOPMENT FOR AFFORDABLE HOUSING AND SUSTAINABLE COMMUNITIES <br />PROGRAM FUNDS, AND EXECUTE DOCUMENTS TO ACCEPT THE PROGRAM FUNDS <br /> <br />WHEREAS, the State of California is accepting applications for funding under the Affordable <br />Housing and Sustainable Communities (AHSC) Program established under Division 44, Part 1 of the Public <br />Resources Code commencing with Section 75200; and <br /> <br />WHEREAS, the City of San Leandro, Bay Area Rapid Transit District, and Pacific West <br />Communities each have projects that when combined qualify for funding under the Program; and <br /> <br />WHEREAS, only two entities can be listed on the funding application. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br />That the City Manager shall submit on behalf of the City an AHSC Program Application as co- applicant with <br />Pacific West Communities in a total amount not to exceed $50,000,000 of which up to $35,000,000 is <br />requested as a loan for an Affordable Housing Development, and up to $15,000,000 is requested for a grant <br />for Housing-Related Infrastructure, Sustainable Transportation Infrastructure, Transit-Related Amenities, or Program <br />activities as defined in the AHSC Program Guidelines; and <br /> <br />That the City Manager may enter into an agreement with BART obligating BART to construct certain <br />improvements and obligating the City to forward certain proceeds from the Program Funds to BART, in <br />the event the Program Funds are awarded to the City; and <br /> <br />That if the application is approved, the City Manager may execute a State of California Standard Agreement <br />in a total amount not to exceed $15,000,000, and any and all other documents required or deemed <br />necessary or appropriate to secure the AHSC Program funds from the Department and all amendments <br />thereto including an AHSC Program Application and AHSC Documents as required by the Department for <br />participation in the AHSC Program, and <br /> <br />That the City Manager is authorized to make non-substantial revisions to said agreement with BART, <br />subject to approval as to form by the City Attorney. <br /> <br />Introduced by Councilmember and passed and adopted this 4th day of March 2024, <br />by the following vote: <br /> <br />AYES:
