B IOLOGICAL A SSESSMENT <br />A PRIL 2020 <br />S AN L EANDRO T REATMENT W ETLAND P ROJECT <br />S AN L EANDRO, A LAMEDA C OUNTY, C ALIFORNIA <br /> <br />P:\TER2001\BA\San Leandro Treatment Plant BA 4‐7‐20.docx (04/07/20) 1 <br />1.0 INTRODUCTION <br />1.1 PURPOSE OF THE BIOLOGICAL ASSESSMENT <br />The purpose of this Biological Assessment (BA) is to review and analyze the proposed project in <br />sufficient detail to determine the extent to which it may affect threatened, endangered, or <br />candidate species and designated or proposed critical habitat protected under the Federal <br />Endangered Species Act (FESA) of 1973. <br />LSA has prepared this BA on behalf of the City of San Leandro Public Works Department (City) for <br />use by the U.S. Army Corps of Engineers (Corps) to facilitate consultation with the U.S. Fish and <br />Wildlife Service (USFWS) and National Marine Fisheries Service (NMFS) in accordance with legal <br />requirements set forth under regulations implementing Section 7 of the FESA. In addition to <br />compliance with provisions of the FESA, Section 305(b) of the Magnuson‐Stevens Fishery <br />Conservation and Management Act (Magnuson‐Stevens Act) requires federal agencies to consult <br />with NMFS regarding any action or proposed action that may adversely affect Essential Fish Habitat <br />(EFH) for federally managed fish species. All native San Francisco Estuary fish species are federally <br />managed under the Magnuson‐Stevens Act, and Suisun Bay waters within the project area are <br />considered EFH for fish species covered under the Pacific Groundfish Fishery Management Plan <br />(FMP) and Pacific Salmon FMP. As such, this BA will also address potential effects of the proposed <br />project on EFH. <br />1.1.1 Definitions <br />Definitions of key terms used in this document are provided below. <br />Action Area refers to the area directly or indirectly affected by the proposed project, including <br />adjacent open waters of the San Francisco Bay. A full description of the Action Area is provided in <br />Section 2.3. <br />Project Area refers to the entire area where proposed project activities will occur, including the <br />staging areas, access roads, treatment pond, and the in‐water work at the outfall into the tidal <br />slough. <br />Project Vicinity encompasses all lands within 5 miles of the project area boundary. <br />Proposed Project refers to the San Leandro Treatment Wetland Project for Pollution Reduction, <br />Habitat Enhancement, and Shoreline Resiliency Project, synonymous with "project."
