<br />S AN L EANDRO T REATMENT W ETLAND P ROJECT <br />S AN L EANDRO, A LAMEDA C OUNTY, C ALIFORNIA <br />B IOLOGICAL A SSESSMENT <br />A PRIL 2020 <br /> <br />P:\TER2001\BA\San Leandro Treatment Plant BA 4‐7‐20.docx (04/07/20) 18 <br />2.2.3 Federally Listed Birds and Protection Measures <br />The avoidance and minimization measures described below have been incorporated into the project <br />and will serve as mitigation measures to offset potential effects to the federally listed western <br />snowy plover. Implementation of the following measures would reduce potential adverse effects to <br />western snowy plovers: <br /> The project shall avoid construction activities during the bird nesting season (February 1 through <br />August 31). If construction activities are scheduled during the nesting season, a qualified <br />biologist shall conduct a pre‐construction survey for nesting western snowy plovers within <br />suitable nesting habitat on and within 250 feet of the project site (where accessible). The pre‐ <br />construction survey shall be conducted no more than 14 days prior to the start of work. If the <br />survey indicates the presence of nesting snowy plovers, the USFWS shall be contacted in order <br />to determine the appropriate protective buffer zones to be established around the nests. <br />2.3 ACTION AREA <br />The Action Area is defined in 50 Code of Federal Regulations § 402.02 as “all areas to be affected <br />directly or indirectly by the Federal action and not merely the immediate area involved in the action.” <br />For the purposes of this BA, the Action Area was defined by analyzing the potential extent of effects <br />of the proposed project including temporary impacts to habitat in the tidal slough and species <br />sensitivity to human‐caused disturbance. The Action Area includes the entire project area and <br />extends approximately 25 to 75 feet into the tidal slough (Figure 2).
