Noise <br />ISSUES: NOISE <br />POTENTIALLY <br />SIGNIFICANT <br />IMPACT <br />LESS THAN <br />SIGNIFICANT <br />WITH <br />MITIGATION <br />INCORPORATED <br />LESS THAN <br />SIGNIFICANT <br />IMPACT <br />NO IMPACT <br />Would the Project result in: <br />a) Generation of a substantial temporary or <br />permanent increase in ambient noise levels in the <br />vicinity of the project in excess of standards <br />established in the local general plan or noise <br />ordinance, or applicable standards of other <br />agencies? <br />☐ ☐ ☒ ☐ <br />b) Generation of excessive ground borne vibration <br />or ground borne noise levels? <br />☐ ☐ ☒ ☐ <br />c) For a project located within the vicinity of a <br />private airstrip or an airport land use plan or, where <br />such a plan has not been adopted, within two miles <br />of a public airport or public use airport, would the <br />project expose people residing or working in the <br />project area to excessive noise levels? <br />☐ ☐ ☐ ☒ <br />Discussion <br />a) Generate significant noise. Chapter 4-1 of the City’s Municipal Code provides restrictions and <br />regulations for noise within San Leandro. The noise-related code does not contain numerical noise <br />level limits and is aimed more at prohibiting “disturbing, excessive and offensive noises” so as to <br />abate public nuisances relative to noise.44 Beyond this basic framework, the following regulations are <br />provided in the City’s Municipal Code which addresses the prohibition of construction and stationary <br />operational noise: <br />Construction-related Noise Near Residential Uses. Construction work or related activity which is <br />adjacent to or across a street or right of way from a residential use, except between the hours of <br />7 a.m. and 7 p.m. on weekdays, or between 8 a.m. and 7 p.m. on Sunday and Saturday. No such <br />construction is permitted on Federal holidays. As used in this Article, “construction” shall mean <br />any site preparation, assembly, erection, substantial repair, alteration, demolition or similar <br />action, for or on any private property, public or private right-of-way, streets, structures, utilities, <br />facilities, or other similar property. Construction activities carried on in violation of this Article may <br />be enforced as provided in Section 4-11-1130, and may also be enforced by issuance of a stop <br />work order and/or revocation of any or all permits issued for such construction activity. <br />Conflicts with Residential Uses. Subject to the restrictions on constructions contained in <br />subdivision (b), the sustained operation or use between the hours of 9 p.m. and 8 a.m. of any <br />electric or gasoline powered motor or engine or the repair, modification, reconstruction, testing or <br />operation of any automobile, motorcycle, sweeper, vacuum, public address system, whistle <br /> <br />44 City of San Leandro. 2016.
