Consulting Services Agreement between City of San Leandro and Last revised 4/29/2024 <br />Harvest Technical Services for Water Pollution Control Temporary Staffing Page 1 of 5 <br /> <br />EXHIBIT A <br /> <br />SCOPE OF SERVICES <br /> <br />Harvest Technical Services will provide temporary staffing for City of San Leandro Water Pollution Control <br />Plant laboratory. <br /> <br />Additional Terms: <br /> <br />1. SPECIFIC SERVICES. Harvest’s temporary technical personnel services include <br />all activities relating to the recruiting, interviewing, hiring, compensation, payroll reporting, <br />worker's compensation insurance, and fringe benefits of temporary employees supplied to Client <br />under this Agreement. The site supervision and occupational safety compliance of Harvest <br />employees assigned to the Client for the agreed upon duties are the Client’s responsibility. Client <br />acknowledges and agrees that it may not alter or change the provisions of individual assignment <br />agreements between Harvest and their temporary technical personnel assigned to Client. <br /> <br />2. EQUAL EMPLOYMENT OPPORTUNITY. HARVEST COMPENSATION. In consideration for the services provided to Client <br />under this Agreement, Client will pay Harvest a fee on the basis of the hours worked by the <br />employee or employees assigned to Client, multiplied by the hourly rate(s), as agreed between <br />Harvest and Client. <br /> <br />For purposes of this Agreement, "recruited personnel" means any Harvest candidate that is referred or <br />presented to the City, and "payroll service personnel" means any candidate pre -identified by City and <br />referred to Harvest for employment. Harvest will submit its invoice to City weekly for all employee hours <br />worked in the prior week. Harvest will invoice City on the basis of the hours worked as shown on the <br />Harvest timecard. <br /> <br />4. EMPLOYEE SCHEDULE. Harvest employee(s) will work the schedule that is <br />specified by City at the beginning of the assignment, subject to modification agreed upon by City <br />and Harvest, including all legally required rest breaks and meal breaks. Unless specifically <br />instructed and authorized by City, Harvest employee(s) may not work any overtime, as defined <br />under California labor laws. <br /> <br />5. EMPLOYEE EXPENSES. City agrees to reimburse out-of-pocket expenses <br />actually and reasonably incurred by any Harvest employee assigned to City, in performing the <br />assigned services, provided that Harvest submits a written expense report and supporting <br />documentation to City promptly. Expenses will be included on Harvest’s invoice and subject to <br />the Payment Terms summarized below.
