MEMORANDUM OF UNDERSTANDING <br />This is a memorandum of understanding (MOU) between the City of San <br />Leandro and ATCNancom, Inc. dba ATC, (herein called "ATC"), the ADA <br />Paratransit Broker (broker) for the East Bay Paratransit Consortium of AC Transit <br />and BART (herein called "Consortium"). <br />WHEREAS ATC is the entity selected by the Consortium created by AC Transit <br />· and BART to provide ADA paratransit services in the combined service area of <br />AC Transit and BART; and <br />WHEREAS the City of San Leandro receives funding from Measure B sales tax <br />rev~nue for non-mandated paratransit services; and <br />WHEREAS the City of San Leandro desires to coordinate their Measure B <br />funded non-mandated paratransit services with the ADA paratransit services to <br />be delivered by the Consortium while the City develops a long term strategy for <br />use of these Measure B funds; and <br />WHEREAS the Consortium has indicated a willingness to provide coordinated <br />Measure B paratransit service, through its broker, in the same manner as it <br />provides ADA paratransit service to residents· of the City of San Leandro while <br />the city develops a long term strategy for the use of its Measure B funds; <br />THEREFORE: ATC and the City of San Leandro agree as follows: <br />1. The broker will provide paratransit services to residents of the City of San <br />Leandro who are certified as eligible for ADA paratransit but where the <br />ride requested is not ADA eligible because it is outside the days and <br />hours of comparable fixed route operation in the City of San Leandro. <br />2. The broker will provide paratransit services to residents of the City of San <br />Leandro during the period where the ADA eligibility is being determined <br />following a specific request from the City of San Leandro for that <br />individual. Should the individual be found to be ineligible upon completion <br />of the process, the broker will cease to provide service for that individual. <br />. 3. The broker may provide additional services such as group trips upon a <br />specific request by the City· of San Leandro and with the specific <br />concurrence of the ADA administrative staff of BART and AC Transit. <br />4. The period of this MOU will be from June 1, 2002 through June 30, 2003. <br />5. Services provided under this agreement shall be provided on the same <br />basis and with the same considerations and limitations as the <br />Consortium's ADA services, e.g. reservation service is to be available <br />1
