Consulting Services Agreement between City of San Leandro and Exhibit A <br />GPA Consulting for Environmental Services for Lake Chabot Road Erosion Repairs Page 8 of 11 <br /> <br />• The report will be used to assist the design team in avoiding impacts to jurisdictional areas, provide the <br />jurisdictional information necessary for the supporting project environmental documentation, and support <br />the applications for regulatory permit authorizations. <br />• A draft report will be submitted and coordination with the City and Caltrans will be provided as needed for <br />review and approval of the report <br /> <br />Task 6.3 Deliverables: One electronic copy of the Draft and Final Aquatic Resources Delineation <br />Report <br /> <br />Task 6.4: Federal Endangered Species Act (Section 7) Consultation <br />• According to preliminary database searches, there is potential for several federally listed, candidates, and <br />proposed threatened and endangered species to be in the project area, including pallid manzanita <br />(Arctostaphylos pallida), monarch butterfly (Danaus plexippus plexippus pop. 1), northwestern pond turtle <br />(Emys marmorata), Alameda whipsnake (Masticophis lateralis euryxanthus), foothill yellow-legged frog - <br />central coast DPS (Rana boylii pop. 4), and California red-legged frog (Rana draytonii). Impacts on these <br />or other federally listed species would require consultation under the Federal Endangered Species Act <br />(FESA). <br />• If required, a Section 7 Consultation initiation package will be prepared, including the Biological <br />Assessment (BA), and coordination as needed for review and submittal of the BA to Caltrans for their <br />consultation with the USFWS. <br />• Attendance of up to two virtual meetings held as part of the consultation process. <br />• Ongoing support to the City will be provided to streamline the FESA process, including preparation of <br />supplemental information requested by any of the agencies. <br />• Technical assistance will be provided to the design engineers and City to refine impact avoidance, <br />minimization, and mitigation measures, as required by resource agencies to reduce project impacts on <br />listed species to the maximum extent feasible. <br />• <br />Task 6.4 Deliverables: One electronic copy of the Draft and Final Biological Assessment <br /> <br />Task 6.5: California Endangered Species Act Consultation <br />• According to database searches and preliminary review, there may be potential for several state-listed <br />threatened and endangered species to be in the project area, including pallid manzanita, Crotch bumble <br />bee (Bombus crotchii), western bumble bee (Bombus occidentalis), Alameda whipsnake, and foothill <br />yellow-legged frog - central coast DPS. Take of these species requires consultation under the California <br />Endangered Species Act (CESA). If it is determined that the project may result in a take of these or <br />another state-listed species, consultation with the CDFW would be required. <br />• If required, an Incidental Take Permit (ITP) will be prepared with coordination as needed for review and <br />submittal of the ITP Request package to CDFW through their online EPIMS database. <br />• Coordination will be provided to complete the CESA consultation process and. It is assumed for the <br />purposes of this scope of work that a site visit with the CDFW will not be necessary. <br />• Ongoing support to the City will be provided to streamline the CESA consultation processes, including <br />preparation of supplemental information requested by any of the agencies. <br />• Technical assistance will be provided to the design engineers and City to refine impact avoidance, <br />minimization, and mitigation measures, as required by resource agencies to reduce project impacts on <br />listed species to the maximum extent feasible. <br /> <br />Task 6.5 Deliverables: One electronic copy of the ITP Request and submittal of the request through the <br />CDFW EPIMS online database <br /> <br />Docusign Envelope ID: 78E72B1A-FA71-4376-9F02-D7D222FBE69F
