EXHIBIT F <br />PERFORMANCE STANDARDS & LIQUIDATED DAMAGES <br />July 15, 2024 Page F-2 Post-Collection Agreement, Exhibit F <br /> <br />Event of Non-Performance Definition Liquidated Damage Amount <br />Failure to meet vehicle turnaround guarantees <br />specified in Section 5.2. <br />Contractor shall operate the Approved <br />Facilities such that vehicle turnaround <br />times do not exceed the maximum <br />vehicle turnaround time identified in <br />Section 5.2.7 <br />For Collection Contractor vehicles: <br />$100 per vehicle delayed. <br />Failure to receive vehicles during operating hours <br />specified in Section 5.2.4. <br />Failure of the Contractor to open the <br />Approved Facility to the Collection <br />Contractor during operating days and <br />hours specified in Section 5.2.4. <br />$1,000 per hour that the Approved Facility <br />is not open to receive the Collection <br />Contractor. <br />Failure of Contractor to separately receive, store, <br />Transfer, or otherwise manage different streams of <br />materials received at the Approved Facility(ies) in a <br />manner that does not result in contamination. This <br />would not apply to loads that have excess <br />contamination as set forth in Section 5.2.3 of the <br />Agreement. <br />Failure of Contractor to separately <br />receive, store, Transfer, or otherwise <br />manage Recyclable Materials, Yard <br />Waste, Food Scraps, Organic Materials, <br />or C&D Debris that were Source <br />Separated by the Generator or Person <br />delivering the material and that were <br />delivered to the Approved Facility in a <br />manner that does not result in <br />contamination <br />$100 per Ton for each Ton of material <br />that has been combined, mixed, or <br />contaminated with another material <br />stream rather than separately managed, <br />where the total Tons per incident shall be <br />the combined Tonnage of the two (2) or <br />more material streams or contaminants <br />that were combined or mixed. <br />Failure of Contractor to achieve regulatory <br />compliance performance standards of Section 5.2.1. <br />For each Notice of Violation resulting in <br />an enforcement action that any part of <br />Contractor’s Approved Facility(ies) <br />receives from any regulatory body <br />related to Contractor responsibilities as <br />it pertains to the operation of the <br />Approved Facility(ies) as outlined in this <br />Agreement. <br />$5,000 per month or portion thereof until the <br />Notice of Violation is resolved. <br />Failure of Contractor to perform required SB 1383 <br />material sampling or to properly conduct the <br />sampling, sorting, or measurements as required <br />under Applicable Law <br />Failure of Contractor to perform the SB <br />1383 material sampling, sorting, or <br />measurements required under SB 1383. <br />$500 per sample not collected in a given <br />quarter or per sample in which the <br />sampling, sorting, or measurements were <br />not properly conducted. <br />Timeliness of submissions of reports to the City.
