Litigation and Regulatory Actions <br />Describe past and pending civil, legal, regulatory, and criminal actions (including arrests, <br />indictments, litigation, grand jury investigations, etc.) now, pending, or that have occurred from 2018 <br />to the present against key personnel, proposing private or public entity, its parent company, and all <br />subsidiaries owned by proposing entity, as applicable. <br />We limited the scope of our inquiry as follows: <br />• The proposer’s parent (USA Waste of California, Inc.) operates throughout California, so we <br />only included matters in our Northern California market area. <br />• Regarding environmental regulatory matters, we only included those that were at the level of <br />an enforcement action (not mere NOV’s, for example). However, we did include NOV’s in <br />Section 2 responses if there was a fine, penalty or settlement. <br />• Regarding employment regulatory matters, we did not include those in which an employee <br />merely submitted a complaint to the agency, such as the EEOC. However, we did include all <br />employment matters if they involved litigation or if the regulatory agency took enforcement <br />action against WM. <br />• Regarding criminal matters, we excluded traffic related violations. <br />• Individual party names were omitted due to privacy and confidentiality. <br /> <br />Matter Jurisdiction WM Close Date Description <br />xxxx v. USA <br />Waste of California, <br />Inc. <br />CalRecycle 3/20/2019 Alleged violations of California <br />Beverage Container Recycling <br />and Litter Reduction Act for <br />five violations related to <br />payment and recordkeeping <br />requirements for California <br />recyclable commodity credits. <br />Matter settled. <br />xxxx v.
