Carpet 588 <br />4.4 SOLID WASTE AND RESIDUE DISPOSAL 589 <br />A. General. Contractor shall Accept all Solid Waste at the Approved Disposal Facility and shall Dispose 590 <br />of such material in accordance with Contractor’s Proposal as detailed in Exhibit G. Contractor shall 591 <br />operate the Approved Disposal Facility in accordance with Applicable Law and all standards of 592 <br />performance described in this Section and in Article 5. 593 <br />B. Capacity Guarantee. Contractor guarantees sufficient capacity at the Approved Disposal Facility to 594 <br />receive all City Delivered Materials throughout the Term of the Agreement. Contractor shall 595 <br />annually provide evidence of the current and future capacity of the Approved Disposal Facility in 596 <br />accordance with Exhibit D, Section 3.3. 597 <br />C. Disposal Specifications. Contractors shall operate, manage, and maintain the Solid Waste fill areas, 598 <br />including the placement, burying, and compaction of Solid Waste in the refuse fill areas; stockpiling, 599 <br />placement, and compaction (if necessary) of daily cover, intermediate cover, and final cover; and, 600 <br />management of fill operations including, but not limited to fill sequencing, side slopes configuration, 601 <br />and working face location and configuration. 602 <br />Contractor shall safely and lawfully Dispose of City Delivered Materials at the Approved Disposal 603 <br />Facility in lined cells meeting requirements of Subtitle D of RCRA, if such cells are required in 604 <br />accordance with Applicable Law. 605 <br />Contractor shall operate, maintain, and manage leachate and landfill gas management systems, 606 <br />groundwater monitoring and management systems, storm water drainage and control systems, 607 <br />treatment facilities, buildings, on-site roadways, utilities, and any other required Approved 608 <br />Disposal Facility elements. 609 <br />D. Closure and Post Closure. Contractor shall safely operate, maintain, and manage the Approved 610 <br />Disposal Facility in compliance with Applicable Law not only during the Term, but also thereafter 611 <br />until and during the Facility Closure and Post-Closure period(s) (including fulfillment of State funding 612 <br />requirements). Contractor’s compliance obligations include compliance with the Closure/Post-613 <br />Closure requirements of California's Department of Resources Recycling and Recovery (CalRecycle) 614 <br />throughout the Term of this Agreement and through the required Federal, State, or local Post-615 <br />Closure period. Contractor is solely responsible, operationally and financially, for: (i) the appropriate 616 <br />Closure and Post-Closure activities of the Facility; and, (ii) the establishment and funding of any 617 <br />reserve funds required by Applicable Law for the purposes of providing funds for the payment of 618 <br />costs of Closure of the Approved Disposal Facility (or any cell within the Approved Disposal Facility) 619 <br />or Post-Closure activities relating to the Approved Disposal Facility. Contractor shall not hold City or 620 <br />the Collection Contractor responsible for paying any deficiencies in required reserves.
