<br />July 15, 2024 Page 15 City of San Leandro Post Collection <br />eighty-five percent (85%) (assuming no residue for inbound tons) for Source Separated C&D Tons 543 <br />delivered by the Collection Contractor. Contractor shall obtain City approved C&D certification from 544 <br />Third-Party C&D Accreditors to ensure compliance with such Diversion requirements, Applicable 545 <br />Law, and generally accepted Processing and Diversion standards. Contractor shall maintain records 546 <br />of any information or documentation required to demonstrate compliance with the City approved 547 <br />Third-Party C&D Accreditor requirements and immediately notify the City of changes to the 548 <br />Contractor’s certification status. Contractor shall maintain the Third-Party C&D Accreditor’s 549 <br />certification for the Term of the Agreement. City may request that documentation related to 550 <br />Contractor’s certification by a Third-Party C&D Accreditor be included in the monthly or Annual 551 <br />Report(s). City shall notify the Contractor of this request within ten (10) Business Days prior to the 552 <br />submittal deadline of the monthly and/or Annual Report where the information is to be included. 553 <br />Contractor shall comply with the data collection and recordkeeping requirements of CalRecycle 554 <br />and CALGreen including Part 11 CALGreen requirements for the Processing and Recycling of C&D 555 <br />Debris including Organic Waste. Contractor shall cooperate with efforts by City to comply with 556 <br />CALGreen requirements as provided above. Such cooperation shall include utilizing the 557 <br />recordkeeping and data tracking system requested by the City. Further cooperation may include 558 <br />assisting City with preparation and distribution of informational materials and providing City with 559 <br />any records and information that the City Contract Manager believes is reasonably necessary to 560 <br />demonstrate compliance. 561 <br />D. Residue Allocation and Disposal. Contractor shall use the method of tracking and allocating C&D 562 <br />Residue levels approved by the City and outlined in Contractor’s Proposal detailed in Exhibit G. 563 <br />Contractor’s Residue allocation methodology shall allow Contractor to accurately allocate the City’s 564 <br />share of the total Residue generated from the Processing of C&D at the Approved C&D Processing 565 <br />Facility. Contractor shall not change the Residue level calculation method without prior, written, 566 <br />approval from the City. 567 <br />Residue from the Contractor’s Processing of C&D shall be Transported and Disposed of by 568 <br />Contractor at Contractor’s sole expense. Contractor shall be fully responsible for the safe Disposal 569 <br />of all such Residue in accordance with Applicable Law. Residue delivered for Disposal shall not 570 <br />include any Excluded Materials. 571 <br />E. Marketed Commodities. Contractor shall market Diverted materials in the Commodity categories 572 <br />and grades listed in this Section. If the Contractor wants to modify the Commodity categories or 573 <br />grades during the Term of the Agreement, the Contractor shall request approval from City and such 574 <br />approval shall be obtained before changes are implemented. Commodity categories and grades 575 <br />shall include, at minimum: 576 <br />1. Cardboard 577 <br />2. Metal/Steel 578 <br />3. Plastics 579 <br />4. Glass 580 <br />5.
