July 15, 2024 Page 15 City of San Leandro Post Collection eighty-five percent (85%) (assuming no residue for inbound tons) for Source Separated C&D Tons 543 delivered by the Collection Contractor. Contractor shall obtain City approved C&D certification from 544 Third-Party C&D Accreditors to ensure compliance with such Diversion requirements, Applicable 545 Law, and generally accepted Processing and Diversion standards. Contractor shall maintain records 546 of any information or documentation required to demonstrate compliance with the City approved 547 Third-Party C&D Accreditor requirements and immediately notify the City of changes to the 548 Contractor’s certification status. Contractor shall maintain the Third-Party C&D Accreditor’s 549 certification for the Term of the Agreement. City may request that documentation related to 550 Contractor’s certification by a Third-Party C&D Accreditor be included in the monthly or Annual 551 Report(s). City shall notify the Contractor of this request within ten (10) Business Days prior to the 552 submittal deadline of the monthly and/or Annual Report where the information is to be included. 553 Contractor shall comply with the data collection and recordkeeping requirements of CalRecycle 554 and CALGreen including Part 11 CALGreen requirements for the Processing and Recycling of C&D 555 Debris including Organic Waste. Contractor shall cooperate with efforts by City to comply with 556 CALGreen requirements as provided above. Such cooperation shall include utilizing the 557 recordkeeping and data tracking system requested by the City. Further cooperation may include 558 assisting City with preparation and distribution of informational materials and providing City with 559 any records and information that the City Contract Manager believes is reasonably necessary to 560 demonstrate compliance. 561 D. Residue Allocation and Disposal. Contractor shall use the method of tracking and allocating C&D 562 Residue levels approved by the City and outlined in Contractor’s Proposal detailed in Exhibit G. 563 Contractor’s Residue allocation methodology shall allow Contractor to accurately allocate the City’s 564 share of the total Residue generated from the Processing of C&D at the Approved C&D Processing 565 Facility. Contractor shall not change the Residue level calculation method without prior, written, 566 approval from the City. 567 Residue from the Contractor’s Processing of C&D shall be Transported and Disposed of by 568 Contractor at Contractor’s sole expense. Contractor shall be fully responsible for the safe Disposal 569 of all such Residue in accordance with Applicable Law. Residue delivered for Disposal shall not 570 include any Excluded Materials. 571 E. Marketed Commodities. Contractor shall market Diverted materials in the Commodity categories 572 and grades listed in this Section. If the Contractor wants to modify the Commodity categories or 573 grades during the Term of the Agreement, the Contractor shall request approval from City and such 574 approval shall be obtained before changes are implemented. Commodity categories and grades 575 shall include, at minimum: 576 1. Cardboard 577 2. Metal/Steel 578 3. Plastics 579 4. Glass 580 5.
