Contractor shall have available sufficient back-up vehicles for each 993 <br />type of vehicle used to respond to scheduled and unscheduled maintenance, service requests, and 994 <br />emergencies. Contractor’s vehicles shall utilize Recycled motor oil to the extent practicable (only 995 <br />when authorized engine manufacturer). Contractor shall not place the City's logo on its vehicles. 996 <br />Contractor shall repair, or arrange for the repair of, all of its equipment for which repairs are needed 997 <br />because of accident, breakdown, or any other cause so as to maintain all equipment in a safe and 998 <br />operable condition. 999 <br />5.4 PERSONNEL 1000 <br />A. General. Contractor shall engage, train, and maintain qualified and competent employees, 1001 <br />including managerial, supervisory, clerical, maintenance, and operating personnel, in numbers 1002 <br />necessary and sufficient for operation of Approved Facility(ies) and to perform Post-Collection 1003 <br />Services required by this Agreement in a safe and efficient manner. Contractor shall designate at 1004 <br />least one (1) qualified employee as City’s primary point of contact with Contractor who is principally 1005 <br />responsible for facility operations and resolution of service requests and Complaints. 1006 <br />Contractor shall use its best efforts to assure that all employees present a neat appearance and 1007 <br />conduct themselves in a courteous manner. Contractor shall not permit its employees to accept, 1008 <br />demand, or solicit, directly or indirectly, any additional compensation or gratuity from Collection 1009 <br />Contractor or members of the public. 1010 <br />B. Driver and Equipment Operator Qualifications. All drivers must have in effect a valid driver’s 1011 <br />license, of the appropriate class, issued by the California Department of Motor Vehicles. Contractor 1012 <br />shall use the Class II California Department of Motor Vehicles employer “Pull Notice Program” to 1013 <br />monitor its drivers for safety. All equipment operators shall be appropriately licensed and/or 1014 <br />credentialed, as required by law or Contractor’s policies, for the type and size of equipment they 1015 <br />will operate at all times. 1016 <br />C. Safety Training. Contractor shall provide suitable operational and safety training for all of its 1017 <br />employees who operate vehicles or equipment. Contractor shall train its employees involved in load 1018 <br />inspections to identify, and not to Accept, Excluded Materials. Upon the City Contract Manager’s 1019 <br />request, Contractor shall provide a copy of its safety policy and safety training program, the name 1020 <br />of its safety officer, and the frequency of its trainings. 1021 <br />D. Key Personnel. Contractor shall make every reasonable effort to maintain the stability and 1022 <br />continuity of Contractor’s staff assigned to perform the services required under this Agreement. 1023 <br />Contractor shall notify the City of any changes in Contractor’s key staff to be assigned to perform 1024 <br />the services required under this Agreement and shall obtain the approval of the City Contract 1025 <br />Manager of all proposed key staff member changes who are to be assigned to perform services 1026 <br />under this Agreement within ten (10) Business Days of a key staffing member change. Key staff shall 1027 <br />include the General Manager of each Approved Facility and the Contractor’s District/Area Manager. 1028 <br />The City shall not unreasonably withhold approvals of staff changes and shall respond to approval 1029 <br />requests of a staffing change within five (5) Business Days of Contractor’s notice to the City of such 1030 <br />change. Should the City not respond to a request for approval from Contractor of a staffing change 1031 <br />within five (5) Business Days, the staffing change shall be considered approved. 1032 <br />Notwithstanding City’s approval of Contractor’s personnel, Contractor shall not be relieved from 1033 <br />Docusign Envelope ID: C78C62DE-8589-496F-8F5A-DEC38EE5853C
