<br />July 15, 2024 Page 25 City of San Leandro Post Collection <br />jurisdiction of origin of materials received, type of material, hauler identification and/or 955 <br />classification, type, weight, destination of material (such as, with respect to a Transfer station, to a 956 <br />landfill or material recovery facility operations), and all other information as required in accordance 957 <br />with Article 6. 958 <br />H. Upon-Request Reporting. If vehicle receiving and unloading operations are recorded on video 959 <br />cameras at the Approved Facility(ies), Contractor shall make those videos available for City review 960 <br />during the Approved Facility’s(ies’) operating hours, upon request of the City, and shall provide the 961 <br />name of the driver of any particular load if available. City acknowledges that Contractor only 962 <br />maintains limited video storage capacity and that older video records are overwritten when storage 963 <br />capacity is reached. 964 <br />5.2.9 Safety 965 <br />The Contractor shall perform all Post-Collection Services in a safe manner, in accordance with Applicable 966 <br />Law and insurance requirements provided in Article 9. 967 <br />5.2.10 Due Diligence 968 <br />Contractor acknowledges that management of City Delivered Materials is a public health and safety 969 <br />concern. It agrees that it will exercise due diligence in performing Post-Collection Services. 970 <br />5.2.11 Right to Enter Facility(ies) and Observe Operations 971 <br />The City and its designated representative(s) may enter, observe, and inspect the Approved Facility(ies) 972 <br />at any time during Approved Facility(ies) operations and meet with the Approved Facility(ies) manager(s) 973 <br />or their representatives upon at least seventy-two (72) hours advance request, provided that City and its 974 <br />representatives comply with Contractor’s reasonable safety and security rules and do not interfere with 975 <br />the work of the Contractor or its Subcontractors. 976 <br />Contractor acknowledges City, other governmental agencies, or Extended Producer Responsibility 977 <br />Programs may wish to perform generation and characterization studies periodically with respect to 978 <br />materials covered under this Agreement. Contractor agrees that upon direction from the City, Contractor 979 <br />shall participate in and cooperate with City and other such agencies to perform studies and data collection 980 <br />exercises, as needed, to determine weights, volumes and composition of materials generated, Disposed, 981 <br />Diverted or otherwise Processed at the Approved Facility(ies), as applicable. If City requires Contractor to 982 <br />participate in such a study, Contractor and City shall mutually agree on the scope of services to be 983 <br />provided by Contractor and the amount of compensation, if any, that the City will pay to Contractor for 984 <br />such participation. In accordance with Sections 3.7 and 8.4, if any such studies are required under an 985 <br />Extended Producer Responsibility Program, the Contractor’s participation in such study shall not warrant 986 <br />an increase to the Contractor’s compensation, except as otherwise provided for in Section 8.4. .In any 987 <br />event, Contractor shall permit and in no way interfere with the Transport and handling of the subject 988 <br />materials by other Persons for such purposes. 989 <br />5.3 VEHICLE REQUIREMENTS 990 <br />A. General.
