<br />July 15, 2024 Page 28 City of San Leandro/ACI Franchise Agreement <br />materials are spilled or leaked during Collection and Transportation, the Contractor shall clean up 1079 <br />all spills or leaks before leaving the site of the spill. Contractor’s vehicles shall be equipped at all 1080 <br />times with spill kits, including but not limited to a broom, shovel, and absorbent. 1081 <br />Contractor shall not Transfer loads from one vehicle to another on any Public Street, unless it is 1082 <br />necessary to do so because of mechanical failure, combustion of material in the truck, or accidental 1083 <br />damage to a vehicle. 1084 <br />Contractor shall cover all open Drop Boxes at the pickup location before Transporting materials to 1085 <br />the Designated Facility. 1086 <br />Contractor shall conduct public outreach and staff training to Customers on best management 1087 <br />practices for litter abatement as part of the public outreach program. Such best management 1088 <br />practices include, without limitation: 1089 <br />1. Closing Container lids and right sizing service: Contractor staff will tag overfull Containers with 1090 <br />Courtesy Notices, which will serve as outreach and education to the Customer. Photos of the 1091 <br />Container will be taken by Contractor staff, attached to the Customer’s account, and will be 1092 <br />available to outreach and Customer service staff in order to demonstrate to the Customer 1093 <br />where a problem exists. 1094 <br />2. Outreach to Customer on importance of bagging lightweight materials such as plastic bags, 1095 <br />film plastics, foam peanuts, and other materials that can easily become litter due to their 1096 <br />lightweight nature. 1097 <br />3. Driver training on litter reduction techniques and litter removal best management practices. 1098 <br />4. Affixing signage to the back of Contractor trucks which provides a phone number for residents 1099 <br />to report material spills. 1100 <br />D. Development and Review of Collection Specifications. Contractor shall work with the City to 1101 <br />develop standard specifications for Collection Container enclosures at Commercial and Multi-Family 1102 <br />Premises. These specifications shall be developed to ensure that the Collection Container 1103 <br />enclosures are built to provide adequate space for and suitable configuration to allow the 1104 <br />Contractor to safely and efficiently service Recyclable Materials, Organic Materials, and Solid Waste 1105 <br />Containers. Contractor’s Operations Manager or other appropriately qualified staff shall, upon 1106 <br />request by the City Contract Manager, provide a review of plans for new Single-Family, Multi-Family, 1107 <br />Commercial, or other development or project design drawings. Contractor shall provide comments 1108 <br />and recommendations resulting from the review in writing within ten (10) Working Days of receipt 1109 <br />of the documents for review. In each review report, Contractor shall comment on the acceptability 1110 <br />of the proposed enclosure arrangements in terms of: (i) the adequacy of space for Recyclable 1111 <br />Materials, Organic Materials, and Solid Waste Containers; (ii) the accessibility of the Containers for 1112 <br />Collection including whether additional charges (e.g., Push/Pull Charges) would apply; and, (iii) ease 1113 <br />of use by tenants. 1114 <br />E. No Commingling of Materials. Contractor shall Collect materials generated in the City in Collection 1115 <br />Vehicles separately from other materials generated outside the City Service Area, unless otherwise 1116 <br />approved by the City Contract Manager. In the event that the City Contract Manager approves 1117 <br />comingling of materials generated in the City with materials generated outside the City, on a 1118 <br />temporary or permanent basis, Contractor shall maintain clear records documenting the 1119 <br />methodology used to allocate Collected materials to the City.
