<br />July 15, 2024 Page 31 City of San Leandro/ACI Franchise Agreement <br />Vehicles used in the Collection of Solid Waste, Recyclable Materials and Organic Materials shall be 1212 <br />thoroughly washed on a minimum of one (1) time per week or more frequently if necessary, so as to 1213 <br />present a clean appearance of the exterior and interior compartment of the vehicle under this Agreement. 1214 <br />Contractor's name and local telephone number shall be displayed on all vehicles in at least four (4) inch 1215 <br />characters. Vehicles shall be equipped to allow for educational messaging to be displayed. Contractor shall 1216 <br />provide mock-ups of any truck signage to the City Contract Manager for approval prior to the final printing 1217 <br />or design of such signage. Contractor shall implement any changes requested by the City Contract 1218 <br />Manager including changes to the proposed content or sign size (contingent on size limitations for each 1219 <br />vehicle type). 1220 <br />Contractor shall not place the City's logo on its vehicles. Contractor shall not use vehicles identified for 1221 <br />use in the City in any other jurisdiction, or use vehicles labeled for use in other jurisdictions in the City 1222 <br />without prior approval from the City and subject to the following conditions: 1223 <br />1. Contractor’s use of vehicles identified for use in the City in any other jurisdiction, or use of 1224 <br />vehicles labeled for use in other jurisdictions in the City shall be limited to: i) trucks used for 1225 <br />weekend Recyclable Materials Collection Routes for which Recyclable Materials are allocated 1226 <br />in accordance with subsection three (3) below; ii) trucks used for weekend Organic Materials 1227 <br />or Solid Waste Collection Routes subject to the limitations described in subsection two (2) 1228 <br />below; or iii) trucks used to cover a staff reassignment so long as the truck has been emptied 1229 <br />prior to starting the reassigned route within the City. 1230 <br />2. For any vehicle used for the Collection of Solid Waste from multiple jurisdictions, Contractor 1231 <br />shall weigh, and empty material Collected in between each jurisdiction’s Collection routes 1232 <br />such that the actual tonnage of Solid Waste Collected can be attributed to the correct 1233 <br />jurisdiction of origin. 1234 <br />3. For any vehicle used for the Collection of Recyclable Materials or Organic Materials from 1235 <br />multiple jurisdictions, Contractor shall allocate the Tonnage of Recyclable Materials or 1236 <br />Organic Materials to the City by apportioning to the City its percentage of the total Tonnage 1237 <br />Collected on the shared route based on the aggregate volume, expressed in yards or gallons, 1238 <br />of containers collected. Contractor shall calculate the City’s allocation by dividing the total 1239 <br />Service Level volumes Collected in the City by the total Service Level volumes Collected from 1240 <br />all Containers on the shared route. For example, if Contractor collects three (3) Tons of 1241 <br />Recyclable Materials from Customers with fifty 50 yards of service in San Leandro and one 1242 <br />hundred (100) yards of service in Castro Valley, the City shall be apportioned one (1) Ton or 1243 <br />thirty-three and one-third percent (33.3%) (fifty (50) yards/one hundred and fifty (150) yards) 1244 <br />of the Tonnage collected on that route. 1245 <br />Contractor shall inspect each vehicle daily to ensure that all equipment is operating properly. Vehicles 1246 <br />that are not operating properly shall be taken out of service until they are repaired and operate properly. 1247 <br />Contractor shall repair, or arrange for the repair of, all of its vehicles and equipment for which repairs are 1248 <br />needed because of accident, breakdown, or any other cause so as to maintain all equipment in a safe and 1249 <br />operable condition. City Contract Manager may inspect vehicles at any reasonable time, and within three 1250 <br />(3) calendar days of such a request, to determine compliance with sanitation requirements. 1251 <br />All Collection operations shall be conducted as quietly as possible and shall conform to applicable Federal, 1252 <br />State, County, and City noise level regulations. The City may request Contractor to check any piece of 1253 <br />equipment for conformance with the noise limits in response to Complaints and/or when the City Contract 1254 <br />Manager believes it is reasonable to do so.
