<br />July 15, 2024 Page 32 City of San Leandro/ACI Franchise Agreement <br />subject of noise Complaints from Residents that are near non-Residential service locations, Contractor 1256 <br />shall meet and confer with the City Contract Manager to identify whether alternative Collection times or 1257 <br />methods could be used to mitigate the noise concerns. 1258 <br />Contractor shall furnish the City a written (electronic) inventory of all vehicles, including Collection 1259 <br />vehicles, used in providing service, and shall update the inventory report annually. The inventory shall list 1260 <br />all vehicles by manufacturer, ID number, date of acquisition, fuel type, capacity, and decibel rating. 1261 <br />Contractor shall cooperate with the Designated Facility operators and Approved Facility to ensure that all 1262 <br />Collection vehicles used to deliver Discarded Materials and C&D Debris to the Designated or Approved 1263 <br />Facility(ies) are weighed to determine unloaded (“tare”) weights no later than thirty (30) days prior to the 1264 <br />Commencement Date. Contractor shall coordinate with the Designated Facility or Approved Facility 1265 <br />operators to re-tare vehicles immediately after any major maintenance service on a Collection vehicle and 1266 <br />prior to placing any additional or replacement Collection vehicles into service. 1267 <br />5.5 CONTAINER REQUIREMENTS 1268 <br />A. Containers Provided to Customers. All Carts, Bins, and Drop Boxes, excluding compactors, shall be 1269 <br />provided by Contractor to all Customers as part of services provided by Contractor. Contractor shall 1270 <br />provide Containers for storage and Collection of Solid Waste, Recyclable Materials, and Organic 1271 <br />Materials. Contractor shall provide Containers to new Customers requesting service initiation, or 1272 <br />existing Customers requesting a Used Oil Recovery Kit within five (5) Working Days of Contractor’s 1273 <br />first receipt of the Customer request. Contractor-provided Containers shall be new or clean used 1274 <br />Containers, and Carts and Bins shall be designed and constructed to be watertight and prevent the 1275 <br />leakage of liquids. All Containers shall display the City’s name, Container capacity (yards or gallons), 1276 <br />and some identifying inventory or serial number. 1277 <br />B. Container Standards 1278 <br />1. All Carts shall be manufactured by injection or rotational molding methods. Carts provided 1279 <br />to Customer shall have a useful life of ten (10) or more years as evidenced by a manufacturer’s 1280 <br />warranty or other documentation acceptable to the City. 1281 <br />2. All Containers with a capacity of one (1) cubic yard or more shall meet applicable Federal 1282 <br />regulations for Bin safety and be covered with attached lids. 1283 <br />3. Contractor shall differentiate Solid Waste Containers, Recyclable Materials Containers, and 1284 <br />Organic Materials Containers from each other by providing Containers of different colors 1285 <br />(blue for Recyclable Materials, green for Organic Materials, and grey for Solid Waste), unless 1286 <br />approved otherwise by the City Contract Manager in accordance with this Section and 1287 <br />Applicable Law. 1288 <br />4. Contractor shall obtain the City’s written approval of Container specifications, colors, and 1289 <br />labeling before acquisition, painting, and labeling occurs. 1290 <br />5. When purchasing plastic Collection Containers, Contractor shall purchase Containers that 1291 <br />contain a minimum of 30% post-consumer Recycled plastic content. 1292 <br />6.
