<br />July 2024 Page 26 City of San Leandro Post Collection <br />5.3 VEHICLE REQUIREMENTS 996 <br />A. General. All Post-Collection operations shall, to the maximum extent feasible, maintain and over 997 <br />time further implement a low-carbon or no-carbon footprint in compliance with the Advanced Clean 998 <br />Fleets Rule. 999 <br />B. Maintenance and Operation. Contractor shall provide a fleet of Transfer vehicles sufficient in 1000 <br />number and capacity to efficiently perform the work required by this Agreement in strict 1001 <br />accordance with its terms. Contractor shall have available sufficient back-up vehicles for each type 1002 <br />of vehicle used to respond to scheduled and unscheduled maintenance, service requests, and 1003 <br />emergencies. Contractor shall replace Transfer vehicles in accordance with the schedule contained 1004 <br />in Exhibit G6. All such vehicles shall have watertight bodies designed to prevent leakage, spillage, or 1005 <br />overflow. All Transfer vehicles shall maintain covered loads while in transit such that material from 1006 <br />the vehicle cannot spill, drop, or blow out of the vehicle. Contractor’s vehicles shall utilize Recycled 1007 <br />motor oil to the extent practicable. Contractor shall not place the City's logo on its vehicles. 1008 <br />Contractor shall inspect each Transfer vehicle daily to ensure that all equipment is operating 1009 <br />properly to meet the emission requirements described in this Section and to safely perform all 1010 <br />services required in this Agreement. Transfer vehicles that are not operating properly shall be taken 1011 <br />out of service until they are repaired and operate properly. Contractor shall repair, or arrange for 1012 <br />the repair of, all of its Transfer vehicles and equipment for which repairs are needed because of 1013 <br />accident, breakdown, or any other cause so as to maintain all equipment in a safe and operable 1014 <br />condition. Transfer vehicles used to perform services under this Agreement shall not exceed fifteen 1015 <br />(15) years of age. City Contract Manager may inspect vehicles at any reasonable time, and within 1016 <br />three (3) calendar days of such a request, to determine compliance with this Section. In the event 1017 <br />that the duty cycle of a Contractor’s vehicle is found to be insufficient for Contractor to perform its 1018 <br />obligations under this Agreement, such as excessive vehicle downtime due to maintenance, City 1019 <br />may direct the addition of equipment to Contractor’s fleet, at Contractor’s sole cost. 1020 <br />All Transfer vehicles shall be capable of loading at the Approved Transfer Facility(ies) and unloading 1021 <br />at the Approved Processing or Disposal Facility(ies) by equipment that is compatible with unloading 1022 <br />equipment and procedures at the Approved Facility(ies). 1023 <br />C. Emissions Standards. All Transfer Vehicles shall comply with California Air Resources Board (CARB) 1024 <br />Truck and Bus Regulation (13 CCR 2025) and Advanced Clean Trucks Regulation (13 CCR 1963-1963.5 1025 <br />and 2012-2012.2), including any modifications, administrative or legal determinations, and 1026 <br />amendments thereto. All Transfer Vehicles shall meet On-Road Heavy Duty Vehicle emissions 1027 <br />requirements for model year 2016 or the appropriate emission requirements for the model year of 1028 <br />the vehicle purchased, if newer, and comply with all Federal, State, and local laws and regulations. 1029 <br />Contractor is aware that the Advanced Clean Fleets Rule is a current State law. These requirements 1030 <br />apply to Transfer Vehicles owned by Contractor as well as any Transfer Vehicles used in the 1031 <br />performance of this Agreement. 1032 <br />As of the Effective Date, all Transfer vehicles shall operate on diesel fuel. The Parties acknowledge 1033 <br />the requirements of the Advanced Clean Fleets Rule requiring Contractor to transition to a zero-1034 <br />emission fleet. The Parties further acknowledge that this requires use of new technology that is 1035 <br />both relatively expensive and technically unproven compared to conventional fleets.
