Contractor and its Subcontractors shall engage, train, and maintain qualified and 1127 <br />competent employees, including managerial, supervisory, clerical, maintenance, and operating 1128 <br />personnel, in numbers necessary and sufficient for operation of Approved Facility(ies) and to 1129 <br />perform Post-Collection Services required by this Agreement in a safe and efficient manner. 1130 <br />Contractor shall designate at least one (1) qualified employee as City’s primary point of contact with 1131 <br />Contractor who is principally responsible for facility operations and resolution of service requests 1132 <br />and Complaints. Such individual shall be empowered to negotiate on behalf of and bind Contractor 1133 <br />with respect to any changes in scope, dispute resolution, compensation adjustments, and service-1134 <br />related matters which may arise during the Term of this Agreement. 1135 <br />Contractor and its Subcontractors shall use its best efforts to assure that all employees present a 1136 <br />neat appearance and conduct themselves in a courteous manner. Contractor and its Subcontractors 1137 <br />shall not permit its employees to accept, demand, or solicit, directly or indirectly, any additional 1138 <br />compensation or gratuity from Collection Contractor or members of the public. 1139 <br />B. Driver and Equipment Operator Qualifications. All drivers must have in effect a valid driver’s 1140 <br />license, of the appropriate class, issued by the California Department of Motor Vehicles. Contractor 1141 <br />shall use the Class II California Department of Motor Vehicles employer “Pull Notice Program” to 1142 <br />monitor its drivers for safety. All equipment operators shall be appropriately licensed and/or 1143 <br />credentialed, as required by law or Contractor’s policies, for the type and size of equipment they 1144 <br />will operate at all times. 1145 <br />C. Safety Training. Contractor and its Subcontractors shall provide suitable operational and safety 1146 <br />training for all of its employees who operate vehicles or equipment. Contractor and its 1147 <br />Subcontractors shall train its employees involved in load inspections to identify, and not to Accept, 1148 <br />Excluded Materials. Upon the City Contract Manager’s request, Contractor and its Subcontractors 1149 <br />shall provide a copy of its safety policy and safety training program, the name of its safety officer, 1150 <br />and the frequency of its trainings. 1151 <br />D. Key Personnel. Contractor and its Subcontractors shall make every reasonable effort to maintain 1152 <br />the stability and continuity of Contractor’s and its Subcontractors’ staff assigned to perform the 1153 <br />services required under this Agreement. Contractor shall notify the City of any changes in 1154 <br />Contractor’s and its Subcontractors’ key staff to be assigned to perform the services required under 1155 <br />this Agreement and shall obtain the approval of the City Contract Manager of all proposed key staff 1156 <br />member changes who are to be assigned to perform services under this Agreement prior to any 1157 <br />such performance. Key staff shall include the General Manager of each Approved Facility and the 1158 <br />Contractor’s District/Area Manager. 1159 <br />Notwithstanding City’s approval of Contractor’s and its Subcontractors’ personnel, Contractor shall 1160 <br />not be relieved from any liability resulting from the work to be performed under this Agreement, 1161 <br />nor shall Contractor and its Subcontractors be relieved from its obligation to ensure that its 1162 <br />personnel maintain all requisite certifications, licenses, and the like, and Contractor and its 1163 <br />Subcontractors shall at all times ensure that its personnel fully comply with Applicable Law. 1164 <br />E. Wages and Benefits.
