3 2.5.1 Commercial General Liability Insurance. 2.5.1.1 General requirements. Organization, at its own cost and expense, shall maintain commercial general liability insurance coverage for the term of this Agreement in an amount not less than ONE MILLION DOLLARS ($1,000,000) per occurrence and THREE MILLION DOLLARS ($3,000,000) aggregate, combined single limit coverage for risks associated with the work contemplated by this Agreement. 2.5.1.2 Minimum scope of coverage. Commercial general liability coverage shall be at least as broad as Insurance Services Office Commercial General Liability occurrence form CG 0001 (most recent edition) covering comprehensive General Liability on an “occurrence” basis. No endorsement shall be attached limiting the coverage. 2.5.1.3 Additional requirements. Each of the following shall be included in the insurance coverage or added as a certified endorsement to the policy: a. The Commercial General Liability Insurance shall cover on an occurrence basis City, its officers, officials, employees, agents, and volunteers as additional insureds for liability arising out of work or operations on behalf of the Organization, including materials, parts, or equipment furnished in connection with such work or operations; or automobiles owned, leased, hired, or borrowed by the Organization. Coverage can be provided in the form of an endorsement to the Organization’s insurance at least as broad as CG 20 10 11 85, or both CG 20 10 10 01 and CG 20 37 10 01. b. For any claims related to this Agreement or the work hereunder, the Organization’s insurance covered shall be primary insurance as respects the City, its officers, officials, employees, agents, and volunteers. Any insurance or self-insurance maintained by the City, its officers, officials, employees, agents or volunteers shall be excess of the Organization’s insurance and non-contributing. c. The policy shall cover inter-insured suits and include a “separation of Insureds” or “severability” clause which treats each insured separately. d. Organization agrees to give at least 30 days prior written notice to City before coverage is canceled or modified as to scope or amount. 2.4.2 All Policies Requirements. 2.4.2.1 Submittal Requirements. Organization shall submit the following to City prior to beginning services: a. Certificate of Liability Insurance in the amounts specified in this Agreement; and b. Additional Insured Endorsement as required for the General Commercial Liability Policy. 2.5.2.2 Acceptability of insurers.
