2 <br /> <br /> <br />Access to Staff Offices and the Museum proper by Organization is prohibited. In order for <br />Organization to continue to have access to the Staff Breakroom and the refrigerator/freezer space, <br />Organization must clean items out of the refrigerator and freezer space on a monthly basis. <br /> <br />1.2 Use of City Space. Subject to availability, City will provide the Organization with <br />space in the Facilities as needed to conduct its meetings, programs, performances, and exhibitions <br />of artistic works (collectively, “Programs”). <br /> <br />1.3 Use of Equipment. During the useful life of the Equipment and upon thirty (30) <br />days’ prior written notice from Organization to City, the City will provide the Equipment to <br />Organization at the above-mentioned City facility spaces for use in facilitation of its Programs <br />pursuant to Section 1.2, provided that sufficiently trained Organization staff or City or Library <br />staff are available to transport, set-up, and take-down the Equipment. <br /> <br /> ARTICLE II. ORGANIZATION RESPONSIBILITIES <br /> <br />2.1 Workplace Safety Trainings Required. If Organization employs one person while <br />this Agreement is in effect, Organization shall automatically and without any notice requirement <br />from City provide City with proof of completion of all required safety trainings under the <br />California Division of Occupational Safety and Health (“CA OSHA”). <br /> <br />2.2 Americans with Disabilities Act Conformity. Organization shall provide <br />Americans with Disabilities Act access and reasonable accommodations when Organization is <br />using the Facilities and Equipment. All Programs offered by the Organization under this <br />Agreement shall conform with the ADA, including, but not limited to, set design and the provision <br />of reasonable accommodations. <br /> <br />2.3 Building Lock Policies. Organization shall be responsible for locking up the <br />Facilities properly with the provided keys at the end of the day when Facilities are used. Should <br />Organization ever become locked out of the Facilities or lose the provided key, Organization shall <br />contact the Public Library at 510-577-3971 during open library hours and the Library Director at <br />510-421-2343 and/or Assistant Library Director at 510-460-5129 when the library is not open <br />regarding regaining access to the Facilities and/or keys replacement. Organization is responsible <br />for the replacement cost of the keys. <br /> <br />2.4 Assumption of Liability. Organization shall assume liability for any and all actions <br />resulting from failure to lock or secure the Facilities properly. Organization shall indemnify and <br />hold harmless City for any actions resulting from Organization’s failure to properly lock and <br />secure the Facilities, pursuant to Section 3.4. <br /> <br />2.5 Insurance Requirements. Before beginning any services under this Agreement, <br />Organization, at its own cost and expense, shall procure the types and amounts of insurance <br />specified herein and maintain that insurance throughout the term of this Agreement.
