Ord 2025-007 Fire Hazard Severity Zones

IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE NO. 2025-007 ORDINANCE TO REPEAL AND REPLACE MUNICIPAL CODE TITLE 3 CHAPTER 21, TO DESIGNATE FIRE HAZARD SEVERITY ZONES (FHSZ) WITHIN THE LOCAL RESPONSIBILTY AREA (LRA) AS RECOMMENDED BY THE CALIFORNIA DEPARTMENT OF FORESTRY AND FIRE PROTECTION (CAL FIRE) WHEREAS, State law requires the State Fire Marshal to identify areas in the state as moderate, high, and very high fire hazard, and WHEREAS, State law requires the State Fire Marshal notify the City, and requires the City, upon receiving the State Fire Marshal’ s transmittal of the identifications, to designate by ordinance moderate, high, and very high fire hazard severity zones within the City; and WHEREAS, on February 24, 2025, the State Fire Marshal transmitted to the City the zones it recommends within the City, and in accordance with Government Code Section 51178.5, the City made the information available for public review and comment on March 3, 2025; and WHEREAS, after reviewing the Fire Hazard Severity Zones map, Staff recommends that the City update the Fire Hazard Severity Zone map in San Leandro Municipal Code Title 3, Chapter 21 by accepting the Fire Hazard Severity Zones as recommended by the California Department of Forestry and Fire Protection, transmitted to and received by the City February 24, 2025; and WHEREAS, Ordinance No. 2009-001, titled “ORDINANCE ADDING CHAPTER 21 TO TITLE III OF THE SAN LEANDRO MUNICIPAL CODE, RELATING TO VERY HIGH FIRE HAZARD SEVERITY ZONES” should be repealed in its entirety, which will repeal and remove City of San Leandro Municipal Code Title 3, Chapter 21; and WHEREAS, a new ordinance relating to new Fire Hazard Severity Zones in the City of San Leandro based on the recommendation of the State Fire Marshall, should be adopted, which will replace Title 3, Chapter 21. NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as follows: Section 1. Recitals. The Recitals above are true, correct, and made a part of this Ordinance. Section 2. Repeal and Replacement of Current Ordinance. Title 3, Chapter 21 of the City of San Leandro Municipal Code is hereby repealed in its entirety and replaced as follows: § 3-21-100 TITLE. This Chapter shall be known as the Fire Severity Map Ordinance. § 3-21-110 PURPOSE.
