IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2025-078 <br />RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO ENTER INTO A <br />MAINTENANCE AGREEMENT WITH THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION <br />(CALTRANS) FOR MAINTANENCE OF LAW ENFORCEMENT SURVEILLANCE DEVICES (LESD) WITHIN <br />STATE RIGHT-OF-WAY <br /> WHEREAS, the City of San Leandro (the “City”) has installed 80 Flock Automatic License Plate <br />Reader (ALPR) cameras in various locations throughout the City; <br />WHEREAS, these Law Enforcement Surveillance Devices (LESD) are owned and operated by the <br />City for the purpose of law enforcement investigations; <br />WHEREAS, the City has identified additional locations to install and operate four additional Flock <br />ALPR’s within the State of California Department of Transportation (“Caltrans”) right-of-way; and <br />WHEREAS, Caltrans generally does not maintain City property located within the State right- <br />of-way; and <br />WHEREAS, Caltrans is requiring the City to maintain the LESDs at the locations within the State <br />right-of-way as more fully described in Exhibit A to the proposed maintenance agreement, a copy of <br />which is attached, and presented to this City Council; and <br />WHEREAS, City and Caltrans agree that the City will perform maintenance, repair, replacement, <br />installation, removal, and relocation of City owned LESD in the State right-of-way as set forth in the <br />proposed maintenance agreement; and <br />WHEREAS, the City and Caltrans are authorized to enter in this agreement for the maintenance of <br />the State Highway System pursuant to California Streets and Highways Code Sections 114 and 130; and <br />WHEREAS, the use of the LESD equipment has been successful and the San Leandro Police <br />Department recommends approval of said agreement. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br />That said Law Enforcement Surveillance Devices (LESD) Maintenance Agreement with City of San <br />Leandro, substantially in the form presented and attached hereto as Exhibit A, is hereby approved and <br />execution by the City Manager, after approval as to form by the City Attorney, is hereby authorized; <br />That the City Manager is authorized to make revisions to said agreement, subject to approval as to <br />form by the City Attorney; and <br />That the City Manager is authorized to take all actions and execute all documents necessary to <br />effect the purpose and intent of this Resolution; and <br />That an original executed agreement shall be attached to and made a part of this Resolution. <br />
