AN ORDINANCE OF THE CITY OF SAN LEANDRO AMENDING SUBSECTION 4-33-200(C) OF THE SAN LEANDRO MUNCIPAL CODE TO ALLOW FOR A FOURTH CANNABIS DISPENSARY PERMIT WHEREAS, the City Council adopted Cannabis Dispensary Permit regulations under Ordinance No. 2013-020 that established the City’s regulatory framework for commercial cannabis uses; and WHEREAS, under Ordinance No. 2013-020, an initial maximum of one dispensary permit was to be issued within the City, which was subsequently modified by the City Council to allow a second and third dispensary permit; and WHEREAS, the City Council desires to allow for a fourth dispensary permit to be established. NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as follows: SECTION 1. Recitals. The foregoing recitals are true and correct and hereby made a part of this Ordinance. SECTION 2. San Leandro Municipal Code Section 4-33-200(c) Amended. Subsection (c) of San Leandro Municipal Code Section 4-33-200 is hereby amended in its entirety to read as follows: The City shall issue no more than four valid permits for the operation of dispensaries in the City. SECTION 3. San Leandro Municipal Code Section Added. Subsection (h) is hereby added to San Leandro Municipal Code Section 4-33-200 to shall read as follows: (h) No property interest, vested right, or entitlement to receive a future permit to operate a dispensary shall ever inure to the benefit of such permit holder as such permits are revocable. Permits issued pursuant to this article are not transferable to another individual or as to another physical location without City approval. SECTION 4. Severability. In the event any section or portion of this Ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. SECTION 5. Effective Date and Publication. This Ordinance shall become effective thirty (30) days after its adoption. The City Clerk shall have this Ordinance published in a newspaper of general circulation within fifteen (15) days after its adoption or have a summary of the Ordinance published twice in a newspaper of general circulation, once five days before its adoption and again fifteen days after its adoption.
