<br /> <br />AN ORDINANCE OF THE CITY OF SAN LEANDRO <br />AMENDING SUBSECTION 4-33-200(C) OF THE SAN LEANDRO <br />MUNCIPAL CODE TO ALLOW FOR A FOURTH CANNABIS <br />DISPENSARY PERMIT <br /> <br /> WHEREAS, the City Council adopted Cannabis Dispensary Permit regulations under Ordinance <br />No. 2013-020 that established the City’s regulatory framework for commercial cannabis uses; and <br /> WHEREAS, under Ordinance No. 2013-020, an initial maximum of one dispensary permit was <br />to be issued within the City, which was subsequently modified by the City Council to allow a second and <br />third dispensary permit; and <br /> WHEREAS, the City Council desires to allow for a fourth dispensary permit to be established. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as follows: <br />SECTION 1. Recitals. The foregoing recitals are true and correct and hereby made a part of this <br />Ordinance. <br /> <br />SECTION 2. San Leandro Municipal Code Section 4-33-200(c) Amended. Subsection (c) of San <br />Leandro Municipal Code Section 4-33-200 is hereby amended in its entirety to read as follows: <br />The City shall issue no more than four valid permits for the operation of dispensaries in the City. <br /> <br />SECTION 3. San Leandro Municipal Code Section Added. Subsection (h) is hereby added to San <br />Leandro Municipal Code Section 4-33-200 to shall read as follows: <br />(h) No property interest, vested right, or entitlement to receive a future permit to operate a dispensary <br />shall ever inure to the benefit of such permit holder as such permits are revocable. Permits issued pursuant <br />to this article are not transferable to another individual or as to another physical location without City <br />approval. <br /> <br />SECTION 4. Severability. <br />In the event any section or portion of this Ordinance shall be determined invalid or unconstitutional, such <br />section or portion shall be deemed severable and all other sections or portions hereof shall remain in full <br />force and effect. <br />SECTION 5. Effective Date and Publication. <br />This Ordinance shall become effective thirty (30) days after its adoption. The City Clerk shall have this <br />Ordinance published in a newspaper of general circulation within fifteen (15) days after its adoption or <br />have a summary of the Ordinance published twice in a newspaper of general circulation, once five days <br />before its adoption and again fifteen days after its adoption. <br />
