AN ORDINANCE OF THE CITY OF SAN LEANDRO AMENDING <br />SUBSECTION 4-33-200(c) OF THE SAN LEANDRO MUNCIPAL <br />CODE TO ALLOW FOR A FOURTH CANNABIS DISPENSARY <br />PERMIT <br /> <br /> WHEREAS, the City Council adopted Cannabis Dispensary Permit regulations <br />under Ordinance No. 2013-020 that established the City’s regulatory framework for <br />commercial cannabis uses; and <br /> WHEREAS, under Ordinance No. 2013-020, an initial maximum of one dispensary <br />operating permit was to be issued within the City, which was subsequently modified by the <br />City Council to allow for the issuance of a second and third dispensary operating permits; <br />and <br /> WHEREAS, the City Council wants to allow for the issuance of a fourth dispensary <br />operating permit. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as <br />follows: <br />SECTION 1. Recitals. The foregoing recitals are true and correct and hereby made a part of <br />this Ordinance. <br /> <br />SECTION 2. San Leandro Municipal Code Section 4-33-200(c) Amended. Subsection (c) <br />of San Leandro Municipal Code Section 4-33-200 is hereby amended in its entirety to read <br />as follows: <br />The City shall issue no more than four valid permits for the operation of dispensaries in the <br />City. <br /> <br />SECTION 3. San Leandro Municipal Code Section Added. Subsection (h) is hereby added <br />to San Leandro Municipal Code Section 4-33-200 to shall read as follows: <br />(h) No property interest, vested right, or entitlement to receive a future permit to operate a <br />dispensary shall ever inure to the benefit of such permit holder as such permits are <br />revocable. Permits issued pursuant to this article are not transferable to another individual <br />or as to another physical location without City approval. <br /> <br />SECTION 4. Severability.
