Governor’s Office of Land Use and Climate Innovation– Extreme Heat and Community Resilience Program – Round 1 <br />Grant Number: LCI SPPD24132, City of San Leandro <br />Page 8 <br />Exhibit A: Scope of Work <br />the readiness deadline, and how much additional time is needed for the <br />Grantee to fulfill all remaining readiness requirements. <br />c. If the Project is deemed infeasible and ineligible for reimbursement, <br />Grantee may not allocate Project funds to any different project without <br />written LCI approval. <br />C. CEQA Readiness Requirements <br />a. Grantee is responsible for complying with all applicable laws and <br />regulations for the Project, including the California Environmental Quality <br />Act (CEQA) (PRC § 21000 et seq.) if applicable. Documentation of CEQA <br />compliance must be provided to LCI to establish readiness prior to Project <br />implementation. <br />b. The following documentation is acceptable to demonstrate CEQA <br />compliance: <br />i. Documentation for projects to which CEQA does not apply <br />1. A signed letter or similar document from the head of the <br />administrative approving entity (e.g., Planning Director) of <br />the lead agency stating that CEQA does not apply to the <br />Project and the basis for that determination. <br />ii. Documentation for projects that are categorically or statutorily <br />exempt <br />1. A CEQA Notice of Exemption (NOE) that has been <br />approved by the appropriate body pursuant to their <br />obligations under CEQA; or <br />2. Other documentation confirming that the project is exempt <br />from CEQA, including but not limited to: <br />a. A resolution adopted by the legislative body of the <br />lead agency (e.g., City Council, Board of Supervisors) <br />confirming a project’s exemption. If a resolution or <br />similar mechanism is not available or does not exist, <br />meeting minutes documenting the legislative body’s <br />consideration and approval of the project’s CEQA <br />compliance may be submitted. <br />b. A signed letter or similar document from the head of <br />an administrative approving entity (e.g., Planning <br />Director) of the lead agency. <br />iii. Documentation for all other projects subject to CEQA <br />1. A file-stamped Notice of Determination <br />D. Although not required to establish readiness for Project implementation, Grantee <br />must inform LCI if any legal claims are filed challenging any of the approvals for <br />the Project, including CEQA approvals, within 3 business days of service of the <br />complaint.
