IN THE SAN LEANDRO HILLSIDE GEOLOGIC HAZARD ABATEMENT DISTRICT <br /> <br />RESOLUTION NO. 2025-001 GHAD <br /> <br />RESOLUTION OF THE BOARD OF DIRECTORS OF THE SAN LEANDRO HILLSIDE GEOLOGIC HAZARD <br />ABATEMENT DISTRICT INITIATING DISSOLUTION PROCEDURES PURSUANT TO PUBLIC RESOURCES <br />CODE DIVISION 17, SECTIONS 26500-26654 <br /> <br />WHEREAS, on November 8, 2000, the City Council for the City of San Leandro adopted Resolution <br />No. 2000-172 establishing the San Leandro Hillside Geologic Hazard Abatement District (“GHAD”) under <br />the authority of the California Public Resources Code Division 17, Sections 26500-26654, for the purpose <br />of preventing, mitigating, and abating structural hazards caused by geologic hazards for 26 lots on <br />Hillside Circle, in the Bay-O-Vista area of the City of San Leandro; and <br /> <br />WHEREAS, the Plan of Control dated October 10, 2000, (Project No. 4867.1.002.01) (the “Plan”) <br />as required under California Public Resources Code Section 26553, sets forth the plan for the <br />prevention, mitigation, abatement and control of the GHAD; and <br /> <br />WHEREAS, the Plan provides that the GHAD shall be funded by available state and FEMA funds, <br />and in the event the “GHAD’s funding is, for any reason, exhausted, reduced, or eliminated in the future, <br />the GHAD’s services will also be eliminated or diminished accordingly. The GHAD has no responsibility <br />to perform any activities which exceed its funding capacity”; and <br /> <br />WHEREAS, the GHAD’s funding has been exhausted; and <br /> <br />WHEREAS, there are no outstanding debts or obligations of the GHAD, or adequate provisions <br />that have been made for the payment of such obligations; and <br /> <br />WHEREAS, all assets of the GHAD have been disposed of or will be transferred in accordance <br />with applicable law and in the best interests of the property owners within the GHAD; and <br /> <br />WHEREAS, the dissolution of the GHAD will not adversely affect public safety or the integrity of <br />prior mitigation efforts; and <br /> <br />WHEREAS, the Board of Directors presents the potential findings under Public Resources Code <br />Section 26567.1, that could be made if dissolution is ordered subsequent to the public hearing: <br /> <br />a) The corporate powers of the GHAD have not been used, there is a reasonable probability that <br />those powers will not be used in the future, and the district holds no significant liquid assets; <br />and/or <br /> <br />b) The board of directors, by resolution passed by unanimous vote of the directors, or by a vote of <br />the owners of more than 50 percent of the assessed valuation of the real property in the <br />district, approved the dissolution of the district; and/or <br />
