Page 28 of 68 <br /> <br />Unoccupied Building as used in this chapter shall be a building or structure that is not <br />properly secured, locked or closed and is accessible to juveniles and transients and is a <br />health, fire or safety hazard to the adjacent community. <br /> <br /> <br /> <br />116.3.2 Structures and Equipment. <br /> <br />Structures or existing equipment that are or hereafter become unsafe, insanitary or deficient <br />because of inadequate means of egress facilities, inadequate light and ventilation, or which <br />constitute a fire hazard, or are otherwise dangerous to human life or the public welfare, or <br />that involve illegal or improper occupancy or inadequate maintenance, shall be deemed an <br />unsafe condition. Unsafe structures shall be taken down and removed or made safe, as the <br />Building Official deems necessary and as provided for in this section. A vacant structure <br />that is not secured against entry shall be deemed unsafe. <br /> <br />116.3.3 Property owner. <br /> <br />Property owner as used in this Chapter shall be the last person shown on the most current <br />County assessment roll. <br /> <br />116.3.3.1 Person in Charge. <br /> <br />Person in charge as used in this Chapter shall be the person, if any, in real or apparent <br />charge and control of the premises involved. <br /> <br />116.3.4 Abandonment. <br /> <br />Abandonment as used in this chapter shall be the cessation of use and maintenance. <br /> <br />116.3.5 Declaration of an unsafe building. <br /> <br />Whenever the Building Official determines by inspection that a building or <br />structure, whether structurally damaged or not, is dangerous to human life by reason <br />of being located in an area which is unsafe due to hazard from landslide, settlement, or <br />slippage or any other cause, such building shall, for the purpose of this Chapter, be <br />considered an unsafe building. <br /> <br />No person shall own, use, occupy or maintain any unsafe building. <br /> <br />All unsafe buildings are hereby declared to be public nuisances. In addition to instituting <br />any appropriate action to prevent, restrain or correct a violation of this section, the Building <br />Official may abate an unsafe condition by repair, rehabilitation, demolition or removal in <br />accordance with the procedure specified in this chapter. <br /> <br />116.4 Notice of Unsafe Building. <br />Resolution No. 2025-152
