Page 29 of 68 <br /> <br />The Building Official may examine or cause to be examined any building or structure or <br />portion thereof reported as dangerous or damaged and if, in the Building Official’s opinion, <br />such is found to be an unsafe building as defined in this Chapter, the Building Official shall <br />give to the property owner written notice stating the defects thereof. This notice may require <br />the owner or person in charge of the building or premises to immediately commence either <br />the required repairs or improvements or demolition and removal of the building or structure <br />or portions thereof and all such work shall be completed within a specified time or date <br />stipulated by the Building Official. If necessary, such notice shall also require the building, <br />structure, or portion thereof to be vacated forthwith and not reoccupied until the required <br />repairs and improvements be completed, inspected and approved by the Building Official. <br /> <br />The Building Official shall serve or cause to be served either in the manner required by law <br />for the service of summons or by first class mail, postage prepaid or by posting a copy, the <br />notice of hearing upon the property owner. <br /> <br />In the event the Building Official, after reasonable effort, is unable to serve the notice as <br />specified above, proper service shall be by posting on the structure a copy of the notice. <br /> <br />The designated period within which the owner or person in charge is required to comply <br />with such notice shall begin as of the date the owner or person in charge receives such <br />notice by personal service or registered or certified mail. If such notice is by posting, the <br />designated period shall begin ten days following the date of posting. <br /> <br />The failure of any owner or other person to receive such notice shall not affect in any <br />manner the validity of any proceedings taken hereunder. <br /> <br />A person notified to vacate an unsafe building by the Building Official shall vacate within <br />the time specified in the order. <br /> <br />The Building Official may file with the County Clerk Recorder’s Office a declaration that <br />the building described has been inspected and found to be an unsafe building, as defined in <br />this Chapter, and that the owner thereof has been so notified. After all required work has <br />been completed; the Building Official shall file with the County Clerk Recorder’s Office a <br />properly executed form terminating the above declaration. <br /> <br />116.5 Order to secure buildings or structures. <br /> <br />When the Building Official determines that any unoccupied building or structure is not <br />properly secured, locked, or closed and is accessible to juveniles and transients, and is a <br />health, fire, or safety hazard to the adjacent community, the Building Official shall be <br />authorized to serve the property owner with an order to secure or close the same forthwith <br />so as to prevent unauthorized persons from gaining access thereto. <br /> <br />116.6 Posting of Signs. <br />Resolution No. 2025-152
