<br />Amendment No. 5 to Consulting Services Agreement between the 3/2/2023 <br />City of San Leandro and BKF Engineers (MacArthur/Superior Roundabout) Page 1 of 6 <br /> <br />AMENDMENT NO. 5 TO CONSULTING SERVICES AGREEMENT BETWEEN <br />THE CITY OF SAN LEANDRO AND <br />BKF ENGINEERS <br />FOR <br />MACARTHUR BLVD / SUPERIOR AVE ROUNDABOUT DESIGN PROJECT <br /> <br />This Amendment No. 5 (“Amendment”) is made by and between the City of San Leandro (“City”) <br />and BKF Engineers (“Consultant”) (together sometimes referred to as the “Parties”) as of <br />____________________, 2023, and amends that certain Consulting Services Agreement (“Agreement”) <br />dated May 13, 2016 between the Parties. <br /> <br />WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has <br />provided certain consulting services to City with regard to Civil Engineering design services for the <br />development of construction-ready plans, specifications and estimates for the MacArthur Blvd / Superior <br />Ave Roundabout Design Project, and <br /> <br />WHEREAS, the Parties desire to amend the Agreement to provide additional topographic <br />surveying; soils boring and testing; and Geotechnical, Structural, and Civil design services. <br /> <br />NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby <br />acknowledged, the Parties hereby agree to amend the Agreement as follows: <br /> <br />1. Section 1.1 of the Agreement entitled “Term of Services” is hereby amended to extend the <br />term from June 30, 2021, to June 30, 2024; and <br /> <br />2. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a <br />sum not to exceed THREE HUNDRED NINETY-SEVEN THOUSAND EIGHT HUNDRED FIFTY-NINE <br />DOLLARS ($397,859); and <br /> <br />3. Exhibit A of the Agreement entitled “Scope of Services” is hereby amended to include the <br />following changes: <br /> <br />Addition to Task 1 – Project Management and Coordination <br />The Consultant shall provide additional services including biweekly meetings with the City; coordination <br />meetings with Caltrans, San Leandro, and Oakland; coordination meetings with various utilities; support <br />services related to NEPA and Caltrans right-of-way decertification. <br /> <br />Addition to Task 2 – Preliminary Studies, Investigations, and Design <br />Consultant shall provide additional services related to performing a supplemental topographic survey; slope stability <br />survey; retaining wall preliminary design and type selection; design standards decision document; utility <br />encroachment policy exception request; and miscellaneous memos and reports. <br /> <br />Addition to Task 5 – 100% PS&E <br />Consultant to provide additional services replaced to the preparation and response to design comments for <br />the 100% PS&E package due to Caltrans comments and the additional design work for the retaining wall. <br />DocuSign Envelope ID: 15E9BA7B-F547-4973-8BAD-A8DA8D429D1C <br />March 26, 2023 | 11:29:10 AM PDT <br />Docusign Envelope ID: 03576432-3B39-4EC1-A7D7-FEA905D933FA
