Exhibit A – Page 1 of 2 <br />EXHIBIT A <br />SCOPE OF SERVICES <br />The scope of services includes a variety of tasks within the expertise of the consultant; some of these <br />services may include: <br /> <br />• On-going communications and consulting support related to right of way and property rights issues. <br />• Provide consulting related to right of way processes, project schedule, and considerations to assist <br />the City in alternative selection. <br />• Advise City on compliance with applicable state and federal laws, regulations, and guidelines. <br />• Provide right-of-way planning, strategy and risk analysis. <br />• Recommend courses of action related to real estate, property law, and right of way issues. <br />• Coordination with the City, its employees, agents, and subcontractors regarding what rights may <br />already exist in favor of the City’s project goals, including potential legal counsel determinations <br />related to CA Civil Code Sections 1007 and 1009 regarding prescriptive rights or subsequent <br />sections as it relates to the time of acquisition <br />• Coordination with external agencies in relation to typical/preferred methods for conveying property <br />rights (e.g. Encroachment Permit, License Agreement, Easement), and whether appraisal services <br />and compensation will be expected <br />• Provide appraisal and/or appraisal review services, as needed/requested. <br />• Provide review of all available data and discussion related to potential strategies for the City to <br />acquire or otherwise have rights to construct the project in an efficient, effective, and economic <br />matter. This may include appraisals, partial fee acquisitions, permanent easements, use of <br />prescriptive rights, encroachment permits licenses, temporary construction easements, and <br />acquisition via Eminent Domain if negotiations are unsuccessful. <br />• Prepare acquisition documents such as: offer letter, appraisal summary statement and summary of <br />the basis for just compensation, summary statement pertaining to the acquisition of real property or <br />an interest herein, purchase agreement, deed, TCE agreement and public acquisition brochure. <br />• Provide acquisition/negotiation services, including condemnation support as needed/requested. <br />• Provide relocation planning and/or relocation assistance services, as needed/requested. <br />• Provide support regarding the Right of Way Certification process. <br />• Contract management and budget monitoring. <br />• Public or property owner outreach is required to facilitate acquisitions or other services provided <br />herein. <br />• Compile a comprehensive audit booklet or package in case of audit of external agency/persons <br /> <br />When the consultant’s services are required, staff will forward a request for services to the consultant to <br />receive a proposal. <br /> <br />A Request for Services will have the following information: <br /> <br />1. Project Name <br />2. Project Information: Description of the project, details on any pertinent supporting information, or <br />the availability of existing technical studies; ( Reports or data can be shared to allow accurate <br />determinations of review time for existing information, this information shall be considered <br />confidential or private information )
