<br /> <br /> <br />Stage Equipment Rental Agreement Page 2 of 5 <br />Between City Of San Leandro And San Leandro Improvement Association <br />1.4 Rental Price. The rental price is $0, per day, for a total of $0. The City will send an invoice <br />after the event, in the event the price is over $0. <br /> <br />Section 2. RENTAL. <br /> <br />2.1 Permitted Use. SLIA agrees to use the Equipment solely for the purpose of its performance <br />and participation in the Event and at the location specified. <br /> <br /> 2.2 Handling. SLIA shall use the equipment in a careful and proper manner, ensuring it is <br />operated by qualified personnel. No adhesives, nails, screws, signs, banners, curtains, flags, or other items <br />are to be attached to the interior or exterior of the stage. No adhesives of any kind may be applied to the <br />stage floor, this includes, but is not limited to, duct, gaffers, or masking tape. Any group, organization, or <br />individual so doing will assume financial responsibility for damage, including replacement cost of the unit. <br />Chairs, tables music stands, and other performance equipment are not provided. At all times when the <br />Equipment is in use, all City ordinances regarding noise, traffic, parades, etc., shall be strictly obeyed by <br />stage staff and SLIA. The City reserves the right to stop the program if for any reason there is potential <br />danger to the equipment or persons in their use thereof. Upon termination of this Agreement, SLIA shall <br />return the Equipment to the City in the same condition as received, normal wear and tear excepted. <br /> <br /> 2.3 Subleasing. SLIA shall not sublease the equipment to any other party. <br /> <br /> 2.4 Damage, Loss and Repair. SLIA acknowledges receipt of the Equipment in good, working <br />order. SLIA shall be responsible for all damages to the Equipment, including damage caused by misuse, <br />negligence, or improper transport. In the event the Equipment is damaged, lost, or stolen, Renter agrees to <br />pay the full cost of repair or the replacement cost of the equipment. <br /> <br /> 2.5 Warranties and Representations. No warranties or representations with respect to the <br />suitability of the Equipment for the intended use, either express or implied, are made. <br /> <br />2.6 Condition. The City represents and warrants that the Equipment is in good condition. All <br />defects or damage to the Equipment are deemed to have resulted from the use of the Equipment by SLIA, <br />unless defects or damage were noted, in writing, prior to SLIA’s use of the Equipment. <br /> <br />Section 3. INSURANCE. SLIA shall maintain general liability insurance during the rental term <br />insuring against loss, damage or liability for personal injury, bodily injury or death of any person or loss <br />or damage to property occurring in, upon or about the License Area. SLIA shall furnish the City with <br />certificates of insurance evidencing that SLIA has obtained and maintains insurance in the following <br />amounts: <br /> <br />a. Workers’ Compensation that satisfies the minimum statutory limits. <br /> <br />b. Commercial General Liability and Property Damage Insurance in an amount not less than <br />ONE MILLION DOLLARS ($1,000,000) combined single limit per occurrence, TWO <br />MILLION DOLLARS ($2,000,000) annual aggregate, for bodily injury, property damage, <br />products, completed operations and contractual liability coverage.
