WX66050 <br />GRANT OF EASEMENT <br />F : _603 I M :7?4 <br />MILTON C. IVERSON and SUSAN C. IVERSON, joint tenants, hereinafter <br />called ''Grantors,'' for and in consideration of Three Hundred Dollars ($300), <br />receipt of which is hereby acknowledged, do hereby grant to the CITY OF SAN <br />LEANDRO, a municipal corporation, hereinafter called ''City,'' its successors <br />and assigns, an easement for the purpose and upon the conditions hereinafter <br />set forth upon, along and under that certain strip of real property in the <br />City of San Leandro, County of Alameda, State of California, described as <br />follows: <br />Commencing at the northeastern corner of Lot 13 in Tract <br />596, as shown on the map filed February 18, 1941 in Map <br />Book 21, Page 19, Alameda County Records; thence along the <br />northeastern line of said Lot 13, south 9° 22' 38" east <br />25.43 feet to the ACTUAL POINT OF BEGINNING; thence con- <br />tinuing along the said northeastern line of Lot 13, south <br />9° 22' 38" east 19.30 feet; thence south 29' 04' 21'' west <br />79.55 feet; thence south 31° 10' east 23.02 feet to the <br />southeastern line of said Lot 13; thence along the said <br />southeastern line of said Lot 13, south 58° 50' west 12.00 <br />feet; thence north 31° 10' west 29.98 feet; thence north <br />29° 04' 21" east 101.62 feet to the actual point of <br />beginning. <br />Said easement is and shall be subject to each and all of the following <br />provisions, conditions and covenants: <br />Said easement shall be for the purpose of constructing and maintaining <br />a sanitary sewer. Work to be performed by the City shall be done in such <br />a manner that possible damage to existing structures, paving, plants and <br />other improvements shall be minimized. If existing improvements are damaged, <br />said improvements shall be repaired or the same replaced in kind by the City. <br />In consideration of the easement granted, City agrees to: <br />1. Keep open and passable at all times the driveway to Grantors' <br />premises, except during the trenching, backfilling, and replacement of con- <br />crete across said driveway. <br />2. Provide temporary fencing for the Grantors'property whenever any <br />fencing is removed by City, and to keep said property enclosed during periods <br />between active construction activities.
