<br />CITY OF SAN LEANDRO <br />STAFF REPORT <br /> <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br /> <br />DATE: <br /> <br />November 6, 2006 <br /> <br />Jo <br />Ci <br /> <br /> <br />TO: <br /> <br />John Jermanis, City Manager <br /> <br />FROM: <br /> <br />Hanson Horn, Community Development Director <br /> <br />Debbie Pollart, Planning Manager ~ <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br /> <br />BY: <br /> <br />MATTER OF PROPOSED EXTENSION OF INTERIM URGENCY ORDINANCE <br />(ORDINANCE NO. 2006-017) TO NOVEMBER 6, 2007 OR UNTIL THE <br />ANTICrp A TED ZONING CODE AMENDMENTS RELATED TO THE DOWNTOWN <br />TRANSIT-ORIENTED DEVELOPMENT STRATEGY ARE ADOPTED, <br />WHICHEVER COMES FIRST, PROHIBITING CONSIDERATION AND APPROVAL <br />OF USE PERMITS, VARIANCES, OR OTHER PLANNING ENTITLEMENTS, <br />EXCEPT AS MAY BE APPROVED ADMINISTRATIVELY ON A SHORT-TERM <br />BASIS BY THE CITY MANAGER, FOR CERTAIN PROPERTIES WITHIN THE <br />CITY. <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />· On October 2,2006, the City Council adopted a 45-day interim urgency ordinance <br />prohibiting consideration and approval of use permits, variances, or other <br />planning entitlements for 39 sites identified in the Downtown Transit-Oriented <br />Development (TOO) Strategy as an 'opportunity site'. <br /> <br />· Pursuant to Government Code section 65858, the adoption of an interim <br />ordinance on an urgency basis has an effective period of 45 days maximum. Prior <br />to expiration of this time period, the City Council may extend the interim <br />ordinance (by four-fifths vote) for a period beyond 45 days through a noticed <br />public hearing. <br /> <br />· The City Council finds that it is necessary to allow for the completion of the <br />Strategy, in particular that the Strategy will provide direction for future <br />development of the identified opportunity sites, before potentially long-term <br />uses/development is allowed to take place. <br />
