BROOKS <br />SEPARATE PROPERTY TRUST FOR THE REHABILITATION OF PROPERTY LOCATED <br />IN THE ALAMEDA COUNTY/CITY OF SAN LEANDRO REDEVELOPMENT PROJECT <br />AREA LOCATED AT 14833 EAST 14TH STREET (APN 077D-1475-014-00) <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />As a condition of approval of a Conditional Use Permit approved by the City Council of San <br />Leandro on May 15, 2006, Redevelopment Agency staff has negotiated an Owner Participation <br />Agreement (the "OP A") with the Barbara M. Brooks Separate Property Trust to allow the <br />temporary sale of used automobiles at 14833 East 14th Street. As a result, the Barbara M. Brooks <br />Separate Property Trust has agreed to work with Agency staff to negotiate and execute a master <br />plan for the development of the site and any adjacent property(ies) which may be acquired by <br />the Participant. Staff recommends approval of the attached resolution that authorizes the OP A. <br /> <br />BACKGROUND <br /> <br />Analysis <br />The property was originally occupied by a used car lot in the 1940's. Subsequently, the existing <br />buildings and improvements on the property were constructed in 1966 for a used car sales office <br />that operated for approximately 29 years until 1995. From 1995 to 2005, the United States <br />Postal Service used the site for vehicle storage. In late 2005, the owners ofthe property told City <br />staff that they intended to use the site once again for used car sales. However, because the <br />previous use of the site as a used car lot had lapsed, the owners needed to obtain a conditional <br />use permit to be in conformance with South-Area (SA-3) zoning requirements. The matter <br />relating to the conditional use permit, which was denied by the Board of Zoning Adjustments <br />(the "BZA") at their meeting of February 16, 2006, was heard by the City Council on appeal, at <br />their meeting of April 17, 2006 and then continued to the meeting of May 15,2006. <br />
