CHEN CONSTRUCTION,
INC., TO INCLUDE PHASE 1 OF THE CITY'S RESIDENTIAL NOISE INSULATION
PROGRAM, PROJECT NO. SL-0401.

SUMMARY AND RECOMMENDATION

Based upon Introductory Phase performance and acceptable Cost Estimates for Phase 1, staff
recommends that the City Council approve amendment of the contract with G.E. Chen
Construction, Inc., authorizing the inclusion of Phase 1 of the Airport Noise Insulation Project
and approval of change order in the total estimated amount of $2,224,312.29. Phase 2 is not in
this scope of work. Based upon Phase 1 performance, Phase 2 will be authorized under a change
order or by re-bid. In either event, Council will be asked to approve a Change Order to the
agreement or to award work on Phase 2 to a new contractor.

BACKGROUND

The City of San Leandro entered into a settlement agreement with the Port of Oakland on
December 5, 2000, with an addendum dated July 22, 2003. Under the terms of the agreement,
the Port agreed to fund a City administered Residential Noise Insulation Program. On January
26, 2004, the City Council approved the contractual service agreement with C. Kell-Smith &
Associates, Inc., for professional services related to the administration of the Residential Airport
Noise Insulation Program. On September 2, 2004, C. Kell-Smith administered a lottery to
determine which homes would be participating in the program. The Introductory Phase was
completed and the City Council accepted the work on September 18, 2006. The Introductory
Phase consisted of providing soundproofing of 10 homes to reduce the impact of aircraft
generated noise on the occupants.
