<br />IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2005-014 RDA <br /> <br />(2888) <br /> <br />RESOLUTION APPROVING THE SECOND AMENDMENT TO THE DISPOSITION AND <br />DEVELOPMENT AGREEMENT BETWEEN THE REDEVELOPMENT AGENCY OF THE <br />CITY OF SAN LEANDRO AND 1040 DAVIS STREET PARTNERSHIP LLC FOR THE <br />DISPOSITION AND DEVELOPMENT OF THE PROPERTY LOCATED AT <br />1016,1040,1048, AND 1052 DAVIS STREET <br />(APNS: 075-0148-05,075-0148-06-01, 075-0148-07, 075-0148-08-02) <br /> <br />RECITALS <br /> <br />WHEREAS, the Agency has approved a Disposition and Development Agreement <br />("Agreement") between the Agency and 1040 Davis Partnership LLC ("Developer") to develop <br />an office complex at 1016-1052 Davis Street, which will further the purposes of the Plaza <br />Redevelopment Plan; and <br /> <br />WHEREAS, the Agency prepared a report required by the Health and Safety Code <br />~33433 ("Reuse Report") which contains a summary of the proposed Agreement to be entered <br />into between the Agency and Developer and a summary of the cost of the Agreement to the <br />Agency; and <br /> <br />WHEREAS, subsequent to the Agreement, Agency approved an Amendment to the <br />Agreement to allow Developer to change the Development Plan to renovate and expand the <br />existing building on the site rather than renovate the existing building and construct a new <br />building; and <br /> <br />WHEREAS, the Agency desires to amend the Agreement in order to allow Developer to <br />demolish the existing building and construct a new building of approximately 10,890 square feet <br />and change the site plan accordingly, and to specify the amount of the Agency's loan to <br />Developer for certain City fees as previously approved; and <br /> <br />WHEREAS, the amendment will result in no increase in the cost of the Agency's <br />financial obligation as analyzed in the Reuse Report; and <br /> <br />WHEREAS, the Agency is familiar with the contents of the Second Amendment; and <br /> <br />WHEREAS, the Executive Director recommends approval of the Second Amendment; <br /> <br />NOW, THEREFORE, the Redevelopment Agency of the City of San Leandro hereby <br />resolves as follows: <br /> <br />Section 1. The Second Amendment to the Disposition and Development Agreement <br />between the Agency and 1040 Davis Street Partnership, LLC is hereby approved. <br />
