Cooke, PrinCiPal! ngineer (1~--1 <br /> <br />SUBJECT PROJECTIPROJECT DESCRIPTION: .vvvC <br /> <br />RESOLUTION SUMMARILY VACATING A PORTION OF PUBLIC RlGHT~OF~WAY <br />APPROXIMATELY 1,088 SQUARE FEET IN SIZE AT THE SOUTHWEST CORNER OF <br />MACARTHUR BOULEVARD AND BROADMOOR BOULEVARD <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />A resolution has been prepared to summarily vacate a portion of public right~of~way at the <br />southwest comer of MacArthur Boulevard and Broadmoor Boulevard. Staffs review indicates <br />that these portions of the public right~of~way are not needed for present or prospective public <br />roadway purposes. Staff recommends adoption of the resolution summarily vacating a portion of <br />public right-of-way at the southwest comer of MacArthur Boulevard and Broadmoor Boulevard. <br /> <br />BACKGROUND <br /> <br />311 MacArthur Boulevard, LLC, is the fee owner of thE; abutting property to the southeast of the <br />subject portion of public right-of-way. The owner is proposing to demolish the former Stepping <br />Stones building for the construction of a 23~unit townhouse development. The reversion of the <br />1,088 square foot portion of public right~of-way at the comer of MacArthur Boulevard and <br />Broadmoor Boulevard will facilitate the construction. This portion of the public right~of-way is <br />currently being used for parking by the existing development and will be used for one of the <br />units in the proposed development. <br /> <br />This Planned Development required a rezone of the property and the processing of a Tentative <br />Map and Final Map. A Vesting Tentative Map has been submitted and was approved by the City <br />Council on May 7, 2007. -This proposal includes reworking of the street improvements along <br />MacArthur Boulevard, such as the expansion of an existing bulb-out and the creation of diagonal <br />parking spaces in an area with yellow and white painted curbs. Additionally, an 18~inch storm <br />drain line and two inlets will be installed along MacArthur Boulevard. <br /> <br />Analvsis <br /> <br />A right~of-way summary vacation requires one resolution and no public hearing. Per Chapter 4 <br />of Part 3, Division 9, Section 8331 of the State of California Streets and Highways Code, the <br />legislative body of a local agency may summarily vacate a street or highway if it has been <br />
