When the subdivision was constructed, some backyard <br />fences were built at a height of approximately 3 feet, especially in areas where two lots <br />backing up to each other have a large grade separation. Currently, the Zoning Code does <br />not have different fence regulations for the RS- VP Zoning District, thus a 7- foot tall <br />fence could be constructed by right. <br /> <br />The Planning Commission and staff recommend that the City Council discuss the matter <br />of potential Zoning Code amendments related to regulation of fence heights in the RS-VP <br />District. At the Council's discretion, they may direct staff to analyze the matter. If, <br />through the staff analysis, amendments to the Zoning Code are proposed, these would <br />come before the Board of Zoning Adjustments for comment, then to the Planning <br />Commission for a formal recommendation, and finally to the City Council for final <br />review and action. <br /> <br />DISCUSSION <br /> <br />Fence heights are regulated in Article 16 of the Zoning Code, Section 4-1682. In <br />residentially zoned properties, with the exception of those that are zoned Residential <br />Outer (RO), the maximum fence height permitted in the front/comer side setback is three <br />feet, and outside of those setbacks the maximum height is seven feet. In the RO the <br />maximum height outside of the front/comer side setbacks is six feet (that regulation was a <br />carryover from County regulations, when the RO area was under County jurisdiction). <br />
