<br />CITY OF SAN LEANDRO <br /> <br />STAFF REPORT <br /> <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br /> <br />DATE: <br /> <br />July 2, 2007 <br /> <br /> <br />TO: <br /> <br />John Jermanis, City Manager <br /> <br />FROM: <br /> <br />Michael Bakaldin, Public Works Director <br /> <br />BY: <br /> <br />Delmarie Snodgrass, Marina Manager <br /> <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br /> <br />RESOLUTION APPROVING THE PROCUREMENT OF CHEMICALS TO TREAT THE <br />SHORELINE INVASIVE SPARTINA WITHOUT COMPETITIVE BIDDING BY MEANS OF <br />PIGGYBACKING ON EAST BAY REGIONAL PARK DISTRICT'S APPROVED SOLE- <br />SOURCE PURCHASE <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />Staff recommends Council approve purchasing chemicals needed for the Invasive Spartina <br />Eradication Program without competitive bidding under the terms and conditions of the East Bay <br />Regional Park District's (District) sole-source authorization for the second year. <br /> <br />BACKGROUND <br /> <br />Last year, the City of San Leandro joined with the East Bay Regional Park District in the effort <br />to eradicate the Spartina Alterniflora found in the City's marshlands. The District has been <br />treating the Spartina for the past few years and in the course of administering the project has <br />determined that there is only one herbicide appropriate for treating the species. The District has <br />also determined that due to patent laws, there is no competitive market for the herbicide. <br /> <br />On June 21, 2006, the District's Board approved procurement of the herbicide as a sole-source <br />purchase, waiving competitive bidding. District staff anticipates approval of procurement for the <br />current year to be approved at the July 3, 2007 Board meeting. The City of San Leandro can <br />again piggyback on the pricing, terms and conditions given to the District from the chemical <br />manufacturer, Wilbur Ellis (BASF). <br /> <br />On May 1, 2007, the Assistant City Manager executed an amendment to the original contract <br />increasing the grant from $49,996 to $149,996. The increase in funding is to provide for the <br />increased cost and amount of herbicide to be used in the ground spraying of phase II of the <br />Invasive Spartina Project in San Leandro. In the first year, the cost of the herbicide was <br />$30,374.35 <br />
