MIKE ROGALA'S REQUEST TO <br />RESCIND THE LANDMARK STATUS OF THE REDWOOD TREES LOCATED <br />AT 651 JUANA AVENUE, SAN LEANDRO, CA <br />SUMMARY AND RECOMMENDATION <br />In 2003, the City Council approved a list of historic properties designated fox City Landmark <br />status. Mr. Rogala's redwood trees located at 651 Juana Avenue were included on this list based <br />on a survey that had been completed in 1974. Staff and the Library-Historical Commission <br />recommend the adoption of a resolution approving Mr. Rogala's request to have the redwood <br />trees on his property be rescinded from Landmark status. <br />BACKGROUND <br />In April of 2004, Mr. Rogala attended the Library Historical Commission meeting and presented <br />a letter detailing the numerous maintenance and safety problems caused by the redwood trees <br />located on his property. At that time he did not request his redwood trees be removed as a <br />Landmark. Staff has since researched and found neither documentation nor arborist information <br />to explain why the redwood trees were deemed to be historically significant in 1974. Based on <br />Mr. Rogala's concerns, recordation with the Alameda County Recorder's Office was placed on <br />hold. On January 16, 2007, Mr. Rogala came to the Library-Historical Commission meeting. At <br />that time he asked the Commission to rescind the Landmark status of his redwood trees. He <br />presented his letter and arborist report. Mr. Rogala described the on-going maintenance and <br />safety problems associated with the redwood trees. The Library Historical Commission <br />recommends approval of Mr. Rogala's request as there is no evidence of historical significance <br />of the trees. <br />Current City Council Policy <br />On November 3, 2003, the City Council approved an amended Historic Preservation Ordinance, <br />No. 2003-14. This ordinance supercedes the ordinance adopted in 1974. On December 15, <br />2003, the City Council approved Resolution No. 2003-251, approving designation of certain <br />properties on the City's existing Historic Sites Register as City Landmarks in accordance with <br />Historic Preservation Ordinance No. 2003-014. <br />
