IN THE CITY COUNCII. OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2002 - 02 (2888/ 1024) <br />EXTENSION OF AN INTERIM URGENCY ORDINANCE (ORDINANCE NO. 2001-028) <br />REQUIRING DISCRETIONARY REVIEW OF CERTAIN DEVELOPMENT PROPOSALS <br />AND LAND USE CHANGES WITHIN THE EAST 14Tt' STREET SOUTH AREA UNTIL <br />DECEMBER 17, 2003, OR UNTIL PROPOSED ZONING CODE AMENDMENTS ARE <br />ADOPTED (WHICHEVER OCCURS FIRST) AND DECLARING THIS ORDINANCE TO BE <br />AN URGENCY MEASURE, TO TAKE EFFECT IMMEDIATELY, AS IT RELATES TO THE <br />PRESERVATION OF PUBLIC PEACE, HEALTH AND SAFETY <br />RECITALS <br />A. In October of 2001, the City Council of San Leandro was apprised of and <br />discussed recent development trends along the East 14th Street in the area south of Thornton <br />Street to the City boundary with unincorporated Alameda County (hereafter referred to as the <br />"East 14th Street South Area"). <br />B. The planning for and future development of the East 14th Street South Area is an <br />important component of the City's effort to update its General Plan, forming one of ten (10) <br />focus areas in the City discussed in detail in the current administrative draft, which draft Plan is <br />nearing the public review stage. <br />C. The City's City Council Economic Development Subcommittee and the General <br />Plan Advisory Committee have recommended that the East 14th Street South Area be the subject <br />of a new study, to be undertaken in the near term, leading to a new Development Strategy <br />relating specifically to future development, including public improvements, along this corridor, <br />and requiring changes in zoning and other development regulations affecting the East 14th Street <br />South Area. <br />D. On December 17, 2001, pursuant to San Leandro Municipal Code section 1-I- <br />345(b), and Government Code section 55858, the City Council conducted a noticed public <br />hearing to consider, and thereafter adopted, Ordinance Number 2001-028, an interim ordinance <br />for the purpose of ensuring that the City can preview development proposals that have the <br />potential to impede accomplishment of the objectives of the draft General Plan under <br />consideration, and the Development Strategy the City intends to complete. That interim <br />ordinance was adopted on an urgency basis for a period of forty-five days to institute <br />discretionary review procedures applicable to certain development proposals along the East 14th <br />Street South Area. <br />E. The adoption of this interim ordinance is exempt from environmental review <br />under the California Environmental Quality Act pursuant to Section 15305 of the State CEQA <br />Guidelines, because it is a minor change in land use regulations that will not result in any <br />changes to underlying zoning standards. This Ordinance does not, in itself, approve any <br />development, construction, or change in use, and future projects that maybe considered under <br />the terms of this interim ordinance will be subject to CEQA to the same extent as before its <br />adoption. <br />
