CITY OF SAN LEANDRO <br />STAFF REPORT <br />DATE: July 21, 2008 <br />TO: John Jermanis, City Manager <br />VIA: Perry Carter, Interim Finance Director ~, <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br />John ermanis <br />City ~ager <br />FROM: Mary Ann Perini, Budget & Compliance Manager <br />SUBJECT: MATTER OF IlvIPOSING LIENS FOR NON-PAYMENT OF DELINQUENT <br />SEWER SERVICE CHARGES, 2008 BUSINESS LICENSE TAX, 2008 WEST <br />SAN LEANDRO SHUTTLE BUSINESS IMPROVEMENT DISTRICT FEES, <br />CODE VIOLATION PENALTIES AND/OR WEED ABATEMENT CHARGES, <br />AND SOLID WASTE SERVICE CHARGES <br />SUMMARY AND RECOMMENDATION <br />Staff recommends City Council approval of the attached Resolutions: <br />• Resolution Overruling Protests <br />• Resolution Imposing liens for the non-payment of delinquent solid waste service charges, <br />sewer service charges, community compliance code violation penalties and/or weed <br />abatement charges, and 2008 business license and West San Leandro Shuttle Business <br />Improvement District (BID) fees. <br />Approval of the Resolutions at the close of the public hearing will permit the City to place these <br />delinquent charges on the applicable fiscal year 2008-09 Alameda County secured property tax <br />bills. <br />BACKGROUND <br />Alameda County Industries (ACI) conducts all solid waste activities on behalf of the City of San <br />Leandro. In accordance with the San Leandro Municipal Code ACI has provided the requisite <br />notices regarding the conduct of a public hearing to lien delinquent accounts. <br />The San Leandro Municipal Code provides that delinquent solid waste service, sewer service, <br />community compliance code violation penalties and/or weed abatement charges, West San <br />Leandro Shuttle BID fees and delinquent business license fees shall become a lien on the real <br />property at which the service was received. A detailed listing of all delinquent accounts for each <br />category type is attached. The accounts listed have not been paid as of July 10, 2008, for the <br />services received, although ongoing attempts have been made to collect the balances due. <br />
