CITY OF SAN LEANDRO <br />STAFF REPORT <br />DATE: July 24, 2008 <br />TO: John Jermanis, City Manager <br />FROM: Perry Carter, Interim Finance Director ~= <br />SUBJECT/DESCRIPTION: <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL, <br />John ~ennanis <br />City ager <br />MATTER OF CONSIDERATION OF PLACING AMENDMENTS TO THE UTILITY USERS <br />TAX BEFORE THE VOTERS AT THE NOVEMBER 2008 ELECTION, SUBMITTING <br />ARGUMENTS FOR THE MEASURE AND APPROVING THE FORM OF THE <br />AMENDMENT <br />SUMMARY AND RECOMMENDATION <br />Staff is recommending that the City's Utility Users Tax (UUT) be placed before the voters on the <br />November 2008 election to update certain elements of the ordinance, address legal concerns and <br />effectively lower the UUT rate for Telephone and Video Users from 6% to 5.7%. <br />Accordingly, staff is recommending that Council take the following actions at the July 28, 2008 <br />City Council meeting. <br />1. Adopt a resolution which <br />a. submits an amendment of the City's Utility Users Tax to the voters at the November <br />2008 election by adding Chapter 2-17; <br />b. approves the Form of the Ballot Question; <br />c. sets forth procedures for Ballot Arguments ;and, <br />d. directs the City Clerk to submit the measure to the City Attorney for impartial <br />analysis. <br />e. directs the City Clerk to request the services of the Alameda County Registrar of <br />Voters to conduct the election <br />2. By motion, appoint the Revenue AD Hoc Committee of the City Council to author a <br />Ballot Argument in favor of the amendment to the City's Utility Users Tax. <br />3. Approve the form of the amendment to the City's UUT <br />
