CITY OF SAN LEANDRO
STAFF REPORT
DATE:
TO:
FROM:
BY:
September 15, 2008
Stephen Hollister, Interim City Manager
Jacqui Diaz, Interim Assistant City Manager
APPROVED AND
FORWARDED
TO CITY COUNCIL
Stephen L. Hollister
Interim City Manager
Kathy Ornelas, Community Relations Representatives
SUBJECT PROJECT/PROJECT DESCRIPTION:
AN ORDINANCE AMENDING TITLE 4, CHAPTER 22 OF THE SAN LEANDRO
MUNICIPAL CODE RELATING TO CHARITABLE SOLICITATION PERMITS
SUMMARY AND RECOMMENDATION
It is recommended that the San Leandro Municipal Code sections relating to charitable
solicitation permits be revised.
BACKGROUND
Analysis
The Municipal Codes and processes for issuance of charitable solicitation permits through the
City Clerk's Office were last updated in 1983. Staff is recommending a number of changes be
made to the codes and application process to be more inclusive of information required by permit
applicants.
While many of the changes to the sections are for clarification of procedures or re-numbering for
simplification, some new requirements have been added. For instance, the applicant will be
required to provide proof that the organization has tax exempt status by providing documentation
from the Internal Revenue Service, the California Franchise Tax Board, or the California
Secretary of State.
Also, the name and address of any solicitor collecting under the authority of the permit must be
listed on the application, as well as on the actual permit carried by the solicitors. No person will
be allowed to solicit for contributions unless their name is listed on the permit.
The current code requires submission of a financial statement for the preceding fiscal year from
the charitable organization, as well as a report of the total amount raised within 30 days after the
expiration of the permit. Amendments to the code will allow the City Manager to request these
reports as necessary.
Amendment of § 4-22-220 will list grounds for denial of a permit i£
1) the applicant has not complied with the provisions of this Chapter;
2) the applicant has falsified or intentionally supplied misleading or false information on
the permit application;
