Hollister <br />Interim City Manager <br />RESOLUTION APPROVING A ONE-YEAR EXTENSION TO THE SUBDIVISION <br />IMPROVEMENT AGREEMENT FOR TRACT 7579 LOCATED AT 14953, 14969 AND <br />1A~981-14985 WASHINGTON AVENUE, SAN LEANDRO; OWNER AND SUBDIVIDER: <br />WASHINGTON/SPRINGLAKE PROPERTIES, LLC <br />SUMMARY AND RECOMMENDATION <br />The developer has submitted a request for an extension of time to complete the work required by <br />the subdivision improvement agreement. <br />Staff recommends adoption of a resolution extending the time for performance of the subdivision <br />improvement agreement for another year to December 20, 2009. <br />BACKGROUND <br />On March 20, 2006, by Resolution No. 2006-028, the City Council approved a final subdivision <br />map and improvement agreement for Tract 7579; a development project with forty-three <br />townhouse units on four vacant parcels. On January 22, 2008, by Resolution No. 2008-005, the <br />City Council extended the improvement agreement until December 20, 2008. <br />The developer has installed approximately 95% of the public and private improvements, but has <br />only constructed the first phase of homes (twenty units). The developer requests an extension of <br />the time of performance per the subdivision improvement agreement so that he may complete the <br />improvements. <br />Analysis <br />The developer planned to build the remaining homes prior to completion of the improvements, <br />but the market for new homes remains depressed and the second phase of home construction has <br />not started. This extension will allow the developer additional time in which to construct the <br />improvements. <br />
