Hollister <br />City Manager/Executive Director <br />FROM: Carolyn Knudtso~reation and Human Services Director <br />Luke Sims, Community Development Directo/ <br />BY: Cynthia Battenberg~usiness Development Manager <br />SUBJECT: MATTER OF CITY OF SAN LEANDRO ADOPTION OF JOINT USE <br />AGREEMENT AND REDEVELOPMENT AGENCY ADOPTION OF FINANCING <br />AGREEMENT WITH THE SAN LEANDRO UNIFIED SCHOOL DISTRICT FOR <br />CONSTRUCTION OF A NINTH GRADE CAMPUS, INCLUDING CALIFORNIA <br />COMMUNITY REDEVELOPMENT LAW FINDINGS RELATED TO PUBLIC <br />IMPROVEMENTS OF BENEFIT TO THE ALAMEDA COUNTY-CITY OF SAN LEANDRO <br />JOINT REDEVELOPMENT PROJECT AREA <br />SUMMARY AND RECOMMENDATION <br />The San Leandro Unified School District is constructing a Ninth Grade Campus located within <br />the Joint Alameda County-City of San Leandro Redevelopment Project Area. Financial <br />assistance from the Redevelopment Agency for public improvements and construction of the <br />gymnasium is proposed along with a Joint Use Agreement to provide City use of the gymnasium <br />during non-school hours. Staff recommends City Council and Redevelopment Agency adoption <br />of Resolutions to enter into said Agreements and make necessary Health and Safety Code <br />findings. <br />BACKGROUND <br />Section 33445(a) of the California Community Redevelopment Law (California Health and <br />Safety Code Section 33000 et seq.) (the "Redevelopment Law") requires that the legislative <br />body make certain findings prior to a redevelopment agency's expenditure of tax increment <br />funds for public improvements. These findings must show that: <br />1) the public improvements will be of .benefit to a redevelopment project area or the <br />immediate neighborhood in which the project is located; <br />2) no other reasonable method of financing the public improvements is available to the <br />community; <br />
